Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2014

National Assembly Speaker Maja Gojkovic convened the Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2014, for Saturday, 10 May 2014, starting at 10 am.


The National Assembly adopted the following agenda:

1. Bill amending the Privatisation Law, submitted by the Government;
2. Proposal of the Decision on the appointment and dismissal of members and substitute members of the Republic Electoral Commission, submitted by MP Zoran Babic;
3. Bill amending and modifying the Law on National Councils of National Minorities, submitted by the Government;
4. Bill on Enforcement of Penal Sanctions, submitted by the Government;
5. Bill on Enforcement of Non-Custodial Sanctions and Measures, submitted by the Government;
6. Bill amending and modifying the Criminal Procedure Code, submitted by the Government;
7. Bill on Attorney’s Office, submitted by the Government;
8. Bill on Mediation in Dispute Resolution, submitted by the Government;
9. Bill amending and modifying the Civil Procedure Law, submitted by the Government;
10. Bill amending and modifying the Law on Extra-Judicial Proceedings, submitted by the Government;
11. Bill amending the Law on Enforcement and Security, submitted by the Government;
12. Bill amending the Road Traffic Safety Law, submitted by the Government;
13. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly, submitted by the Democratic Party Parliamentary Group;
14. Proposal of the Decision modifying the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly, submitted by the Serbian Progressive Party Parliamentary Group;
15. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly, submitted by the National Assembly Speaker;
16. Proposal of the Decision Establishing the Composition of the Stabilisation and Association Parliamentary Committee, submitted by the National Assembly Speaker;
17. Proposal of the Decision modifying the Decision Determining the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions (Inter-Parliamentary Union), submitted by the National Assembly Speaker;
18. Proposal of the Decision modifying the Decision Determining the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions (Parliamentary Assembly of the Black Sea Economic Cooperation, NATO Parliamentary Assembly), submitted by the National Assembly Speaker;
19. Proposal of the Decision on the Appointment of Heads of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by the National Assembly Speaker.

By a majority vote, the National Assembly accepted the proposal of MP Zoran Babic to complete a joint debate in principle on the bills listed as items 4, 5 and 6 on the agenda, a joint debate in principle on the bills listed as items 7, 8, 9, 10 and 11 on the agenda and a joint single debate on the decision proposals listed as items13, 14, 15, 16, 17, 18 and 19 on the agenda.

The National Assembly also adopted the proposal of MP Zoran Babic to complete a debate in detail on the Bill amending the Privatisation Law immediately after the completion of the debate in principle on the Bill.

Before recess, the National Assembly commenced the debate in principle on the Bill amending the Privatisation Law, elaborated, on the behalf of the submitter, by Minister of Justice Nikola Selakovic.

At the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the termination of the terms of office of MPs Dr Nebojsa Stefanovic, Aleksandar Vulin, Vanja Udovicic, Jadranka Joksimovic, Goran Knezevic, Radomir Nikolic, Snezana Bogosavljevic Boskovic, Aleksandar Antic, Ivica Dacic and Irena Vujovic before the expiry of the term they were elected for.

At the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly also noted the termination of the term of office of MP Dr Jovan Krkobabic, before the expiry of the term they were elected for, due to death.
After recess, based on the Decision of the Republic Electoral Commission and at the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the verification of the terms of office of MPs Ivica Jevtic, Vesna Simic, Dejan Nektarijevic, Vlado Babic, Sanja Tucakovic, Goran Vukadinovic and Dragan Todorovic, elected from the ALEKSANDAR VUCIC – FUTURE WE BELIEVE IN (Serbian Progressive Party, Social Democratic Party of Serbia, New Serbia, Serbian Renewal Movement, Socialist Movement) Electoral List. The National Assembly also noted the verification of the terms of office of MPs Mirjana Dragas, Grozdana Banac, MA Dejan Radenkovic and Nedjo Jovanovic elected from the IVICA DACIC – “SOCIALIST PARTY OF SERBIA (SPS), PARTY OF UNITED PENSIONERS OF SERBIA (PUPS), UNITED SERBIA (US)” Electoral List and MP Dejan Capo elected from the BORIS TADIC – New Democratic Party – Greens, LSV – Nenad Canak, Together for Serbia, VMDK, Together for Vojvodina, Democratic Left of Roma Electoral List. The newly-elected MPs then proceeded to take the oath of office.

For the remainder of the day the National Assembly conducted and completed the debate in principle on the Bill amending the Privatisation Law.

On the second day of the proceedings, 12 May, the National Assembly commenced a debate in detail on the first item on the agenda – the Bill amending the Privatisation Law.
Minister of Justice Nikola Selakovic attended the sitting as representative of the submitter.
In the course of the sitting, Member of Parliament MA Dejan Radenkovic took the oath of office.
As the National Assembly had concluded the debate on the Bill amending the Privatisation Law, National Assembly Speaker Maja Gojkovic set Monday, 12 May 2014, as Voting Day on the Bill amending the Privatisation Law, starting at 2 pm.

Voting Day

On Voting Day, 12 May, the National Assembly passed, by a majority vote, the Bill amending the Privatisation Law.

In the continuation of the sitting, the MPs commenced a single debate on the Proposal of the Decision on the appointment and dismissal of members and substitute members of the Republic Electoral Commission.
As the National Assembly concluded the single debate, National Assembly Speaker Maja Gojkovic set Monday, 12 May 2014, as Voting Day on the Proposal of the Decision on the appointment and dismissal of members and substitute members of the Republic Electoral Commission, starting at 2:31 pm.

Voting Day

On Voting Day, 12 May, the National Assembly adopted, by a majority vote, the Proposal of the Decision on the appointment and dismissal of members and substitute members of the Republic Electoral Commission.

After recess the National Assembly commenced a debate in principle on the Bill amending and modifying the Law on National Councils of National Minorities.

The Bill amending and modifying the Law on National Councils of National Minorities was presented, on the behalf of the submitted, by Serbian Deputy Prime Minister and Minister of Public Administration and Local Self-Government Dr Kori Udovicki.

On the third day of the proceedings, 13 May, the National Assembly conducted and concluded a debate in principle on the Bill amending and modifying the Law on National Councils of National Minorities.

At the beginning of the proceedings, the heads i.e. authorised representatives of the parliamentary groups, MPs Olgica Batic, Riza Halimi, Aleksandar Senic, Dubravka Filipovski and Prof. Dr Dusan Milisavljevic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

After recess, the National Assembly commenced and, by the end of the day, concluded a joint debate in principle on items 4, 5 and 6 on the agenda, viz. the Bill on Enforcement of Penal Sanctions, Bill on Enforcement of Non-Custodial Sanctions and Measures and the Bill amending and modifying the Criminal Procedure Code. The bills were elaborated by Minister of Justice Nikola Selakovic as representative of the submitter.

On the fourth day of the proceedings, 14 May, the National Assembly commenced a debate in principle on items 7 through 11 on the agenda.

At the beginning of the sitting, the MPs observed a minute of silence for the late MP Miodrag Rakic.

Before recess, Minister of Justice Nikola Selakovic presented the Bill on Attorney’s Office, Bill on Mediation in Dispute Resolution, Bill amending and modifying the Civil Procedure Law, Bill amending and modifying the Law on Extra-Judicial Proceedings and the Bill amending the Law on Enforcement and Security.
For the remainder of the day the National Assembly conducted and then concluded the debate in principle on items 7 through 11 on the agenda.

On 15 May, National Assembly Speaker Maja Gojkovic informed the MPs that, due to the state of emergency in the country, the continuation of the Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2014 scheduled for 3pm today, would be postponed.

On the fifth day of the proceedings, 21 May, the MPs accepted the proposal to include the following items into the agenda by urgent procedure:

- at the proposal of the State Prosecutorial Council: Proposal of the Decision on the Election of Deputy Public Prosecutor,
- at the proposal of National Assembly Speaker Maja Gojkovic: Proposal of the Decision modifying the Decision Determining the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions,
- at the proposal of National Assembly Secretary General Jana Ljubicic: Proposal of the Decision on the Appointment of Deputy Secretaries General of the National Assembly of the Republic of Serbia,
- at the proposal of SPS Parliamentary Group: Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly

The National Assembly completed a debate in principle on the Bill amending the Road Traffic Safety Law. Minister of Interior Dr Nebojsa Stefanovic attended the sitting as a representative of the submitter.

The MPs then proceeded to commence and conclude a joint single debate on the decision proposals listed as items 13-19 on the agenda, after which they completed a single debate on the Proposal of the Decision on the Election of Deputy Public Prosecutor. The Decision Proposal was elaborated by representative of the submitter Branko Stamenkovic, elective member of the State Prosecutorial Council.

The National Assembly completed a joint single debate on the Proposal of the Decision modifying the Decision Determining the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, Proposal of the Decision on the Appointment of Deputy Secretaries General of the National Assembly of the Republic of Serbia, and on the Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly.

By majority vote, the MPs accepted that the following decision proposals, submitted by the High Judicial Council, be included into the agenda for the Second Sitting of the First Regular Session of the National Assembly in 2014, by urgent procedure:

- Proposal of the Decision on the election of presidents of magistrates courts,
- Proposal of the Decision on the election of presidents of basic courts,
- Proposal of the Decision on the election of presidents of commercial courts,
- Proposal of the Decision on the election of presidents of higher courts,
- Proposal of the Decision on the election of President of the Appellate Court in Novi Sad,
- Proposal of the Decision on the election of judges to judicial office for the first time,
- Proposal of the Decision on the election of a judge to judicial office for the first time,
- Proposal of the Decision on the election of judges to judicial office for the first time.

The decision proposals were elaborated by Dragomir Milojevic as representative of the High Judicial Council.

After recess, the National Assembly commenced and by the end of the day completed a discussion on the amendments to the Bill amending and modifying the Law on National Councils of National Minorities.


On the sixth day of the proceedings, 22 May, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Milija Miletic, Dr Janko Veselinovic, Mirko Cikiriz, Prof. Dr Dusan Milisavljevic and Zvonimir Stevic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly then proceeded to conduct and conclude the debate in detail on items 4 through 11 on the agenda.

For the remainder of the day, the National Assembly conducted and then concluded the debate in detail on the Bill on Enforcement of Penal Sanctions, submitted by the Government; Bill on Enforcement of Non-Custodial Sanctions and Measures, submitted by the Government; Bill amending and modifying the Criminal Procedure Code, submitted by the Government; Bill on Attorney’s Office, submitted by the Government; Bill on Mediation in Dispute Resolution, submitted by the Government; Bill amending and modifying the Civil Procedure Law, submitted by the Government; Bill amending and modifying the Law on Extra-Judicial Proceedings, submitted by the Government, and the Bill amending the Law on Enforcement and Security, submitted by the Government.


On the seventh day of the proceedings, 23 May, the National Assembly completed a debate in detail on the Bill amending the Road Traffic Safety Law.

As the National Assembly had concluded the debate on all the items on the agenda, National Assembly Speaker Maja Gojkovic set Friday, 23 May 2014, starting at 10.45 am, as Voting Day on all the items on the agenda for the Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2014, except for items one and two which the National Assembly had already voted on.

On Voting Day, 23 May, the National Assembly passed, by a majority vote, the Bill amending and modifying the Law on National Councils of National Minorities, Bill on Enforcement of Penal Sanctions, Bill on Enforcement of Non-Custodial Sanctions and Measures, Bill amending and modifying the Criminal Procedure Code, Bill on Attorney’s Office, Bill on Mediation in Dispute Resolution, Bill amending and modifying the Civil Procedure Law, Bill amending and modifying the Law on Extra-Judicial Proceedings, Bill amending the Law on Enforcement and Security and the Bill amending the Road Traffic Safety Law.

By a majority vote, the National Assembly also adopted the Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly, submitted by the Democratic Party Parliamentary Group, Proposal of the Decision modifying the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly, submitted by the Serbian Progressive Party Parliamentary Group, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly, submitted by the National Assembly Speaker, Proposal of the Decision Establishing the Composition of the Stabilisation and Association Parliamentary Committee, submitted by the National Assembly Speaker, Proposal of the Decision modifying the Decision Determining the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions (Inter-Parliamentary Union), Proposal of the Decision modifying the Decision Determining the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions (Parliamentary Assembly of the Black Sea Economic Cooperation, NATO Parliamentary Assembly) and the Proposal of the Decision on the Appointment of Heads of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by the National Assembly Speaker.
On Voting Day, by a majority vote, the MPs also adopted the Proposal of the Decision on the Election of Deputy Public Prosecutor and the Proposal of the Decision modifying the Decision Determining the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions.

By a majority vote, the National Assembly appointed Gordana Stamenic and Srdjan Smiljanic, bachelors of laws from Belgrade, Deputy Secretaries General of the National Assembly.

By a majority vote, the National Assembly also passed the Proposal of the Decision modifying the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly.

On Voting Day, by a majority vote, the MPs also adopted the Proposal of the Decision on the election of presidents of magistrates courts, Proposal of the Decision on the election of presidents of basic courts, with amendment of 22 May 2014, Proposal of the Decision on the election of presidents of commercial courts, Proposal of the Decision on the election of presidents of higher courts, with amendment of 22 May 2014, Proposal of the Decision on the election of President of the Appellate Court in Novi Sad, Proposal of the Decision on the election of judges to judicial office for the first time, Proposal of the Decision on the election of a judge to judicial office for the first time and the Proposal of the Decision on the election of judges to judicial office for the first time.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the sMPs complained of in the course of the sitting and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Maja Gojkovic concluded the Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2014.
