Introduction

Law on the National Assembly

Financing of the National Assembly is regulated in Articles 64 to 67 of the Law on the National Assembly.  
Articles 64 to 67 of the Law provide that the National Assembly shall autonomously determine and dispose of funds for the work of the National (hereinafter: the Assembly Budget).  

The Assembly budget represents an integral part of the Budget of the Republic of Serbia. The Government cannot suspend, postpone, or limit the execution of the Assembly Budget without the consent of the Speaker of the National Assembly.

Secretary General issues orders for the use of funds from the Assembly Budget. The procedure for the creation of the Assembly Budget is regulated in the Law on the National Assembly and the National Assembly Rules of Procedure.

Secretary General prepares the Draft Assembly Budget in accordance with the law that regulates the budget system and the Rules of Procedure, and forwards it to the competent committee of the National Assembly (the Administrative Committee).

The competent committee of the National Assembly approves the Draft Assembly Budget and forwards it to the Ministry in charge of finances for opinion. The Minister in charge of finances forwards a reasoned opinion about the Draft Assembly Budget received from the Committee to the competent committee of the National Assembly and, for the purpose of reaching an agreement, presents his/her opinion directly, at the session of the competent committee of the National Assembly.

If an agreement is reached, the competent committee of the National Assembly approves the Assembly Budget. Without any changes, the Ministry in charge of finances includes it in the Draft Budget of the Republic of Serbia, and the Government, also without changes, includes it in the Draft Law on the Budget of the Republic of Serbia.

If an agreement cannot be reached between the competent committee of the National Assembly and the Ministry in charge of finances, the Ministry in charge of finances includes the Draft Assembly Budget forwarded by the competent committee in the Draft Budget of the Republic of Serbia, without changes, and the Government, also without changes, includes it in the Draft Law on Budget of the Republic of Serbia.

In cases when there is no agreement between the competent committee and the Ministry in charge of finances, in its explanation of the Draft Law the Government states why the Ministry is of the opinion that the Draft Assembly Budget is not acceptable.
Secretary General submits to the competent committee of the National Assembly quarterly reports on the use and disposal of the National Assembly funds. The competent committee submits to the National Assembly a report on the use and disposal of the National Assembly funds.

The National Assembly Rules of Procedure

The procedure for creation of the Assembly Budget is regulated in Articles 179 to 181 of the National Assembly Rules of Procedure.
Pursuant to Articles 179 to 181 of the Rules of Procedure, Secretary General prepares the Draft Assembly Budget and submits it to the competent committee (the Administrative Committee).

The Draft Assembly Budget must be reasoned.
The explanation must include:
- Legal grounds for the creation of the Assembly Budget;
- Explanation of funds requested for the functioning of the National Assembly.

The Proposed Assembly Budget is prepared on the basis of the instruction for budget preparation, in accordance with the Memorandum on the Budget and Economic and Fiscal Policies forwarded to the National Assembly by the Ministry in charge of finances.

The Proposed Assembly Budget includes expenditures and expenses of the National Assembly in accordance with the budget classification determined in the law that regulates the budget system.

Secretary General adopts the act that regulates the procedure regarding the preparation of the Proposed Assembly Budget.  

The competent committee reviews the Proposed Assembly Budget within the deadlines that provide for the approval of the Assembly Budget in accordance with deadlines set in the Law that regulates the budget system.
Once it approves the Proposed Assembly Budget, the Committee forwards it to the Ministry in charge of finances for opinion.

The competent committee discusses the reasoned opinion of the Ministry in charge of finances at the session attended by the Minister.

Opinions of the Minister in charge of finances and members of the committee regarding the Proposed Assembly Budget are harmonized at the session of the competent committee.

Once an agreement about the Assembly Budget is reached at the session of the competent committee, the Budget is approved.

If an agreement cannot be reached at the session of the competent committee, the Ministry in charge of finances includes, without changes, the Proposed Assembly Budget in the Draft Budget of the Republic of Serbia, while the Government includes it, also without changes, in the Draft Law on Budget of the Republic of Serbia.

The Assembly Budget, that is, the Proposed Assembly Budget (about which an agreement has or has not been reached at the session of the committee) is forwarded to the Ministry in charge of finances within the deadline set in the Law that regulates the budget system so that it can be included in the Draft, that is, the Proposed Budget of the Republic of Serbia.
