Seventh Extraordinary Sitting of the National Assembly of the Republic of Serbia in 2005

At the request of the Government of the Republic of Serbia, the Chairman of the National Assembly, Predrag Markovic, convened the Seventh Extraordinary Sitting of the National Assembly of the Republic of Serbia in 2005 for 22 June.


At the request of the Government of the Republic of Serbia, the Chairman of the National Assembly, Predrag Markovic, convened the Seventh Extraordinary Sitting of the National Assembly of the Republic of Serbia in 2005 for 22 June. The request for holding the sitting sets out the following agenda:

- Bill Amending and Modifying the Judges Act, proposed by the Government of the Republic of Serbia;

The Deputies adopted the motion to jointly discuss the Bill Amending and Modifying the Judges Act, the Bill Amending and Modifying the Public Prosecutor Act, the Bill Amending and Modifying the Act on the High Judicial Council, the Bill Amending and Modifying the Court Fees Act, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in Suppressing Organised Crime, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in War Crimes Proceedings, and the Bill on the Organisation and Powers of Public Authorities in Suppressing High Technology Crime.

Joint discussion in principle is also to be held on the Deposit Insurance Bill, the Deposit Insurance Agency Bill, the Bill Amending and Modifying the Insurance Act, the Bill on the Bankruptcy and Liquidation of Banks and Insurance Companies, the Bill Amending and Modifying the Act on Banks and Other Financial Organisations, the Bill on the Export Insurance and Financing Agency of the Republic of Serbia, the Bill Amending and Modifying the Guarantee Fund Agency, and the Bill Amending and Modifying the Financial Leasing Act.

On the second day of the session (24 June), the National Assembly held joint debate in principle on the the Bill Amending and Modifying the Judges Act, the Bill Amending and Modifying the Public Prosecutor Act, the Bill Amending and Modifying the Act on the High Judicial Council, the Bill Amending and Modifying the Court Fees Act, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in Suppressing Organised Crime, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in War Crimes Proceedings, and the Bill on the Organisation and Powers of Public Authorities in Suppressing High Technology Crime.

At the beginning of the day’s work, the Minister of Justice in the Government of the Republic of Serbia, Zoran Stojkovic, addressing the deputies as representative of the proposer, said that the proposed amendments and modifications to legislation ordering the judiciary were intended to improve the position of the judiciary and the remuneration of judicial officials, while the Bill on the Organisation and Powers of Public Authorities in Suppressing High Technology Crime was designed to provide legislative basis for combating so-called “cyber crime”, or computer piracy, and the protection of copyright and intellectual property rights.

The Minister of Education and Sports, Slobodan Vuksanovic, informed the National Assembly that the Government had temporarily withdrawn the University Education Bill from procedure in order to discuss the large number of amendments submitted to it.

On the third day of the session (27 June), the National Assembly concluded joint debate in principle on Bills discussed the day before, and commenced joint debate in principle on the the Deposit Insurance Bill, the Deposit Insurance Agency Bill, the Bill Amending and Modifying the Insurance Act, the Bill on the Bankruptcy and Liquidation of Banks and Insurance Companies, the Bill Amending and Modifying the Act on Banks and Other Financial Organisations, the Bill on the Export Insurance and Financing Agency of the Republic of Serbia, the Bill Amending and Modifying the Guarantee Fund Agency, and the Bill Amending and Modifying the Financial Leasing Act.

At the start of the discussion of the package of financial Bills, Mladjan Dinkic, the Minister of Finance in the Government of the Republic of Serbia, presented reasons for proposing new legislation and amending and modifying existing laws.

On the fourth day of the session (28 June), the National Assembly held joint discussion in principle on the the Deposit Insurance Bill, the Deposit Insurance Agency Bill, the Bill Amending and Modifying the Insurance Act, the Bill on the Bankruptcy and Liquidation of Banks and Insurance Companies, the Bill Amending and Modifying the Act on Banks and Other Financial Organisations, the Bill on the Export Insurance and Financing Agency of the Republic of Serbia, the Bill Amending and Modifying the Guarantee Fund Agency, and the Bill Amending and Modifying the Financial Leasing Act.

On day five of the session (29 June), the National Assembly held joint discussion in principle on the Bill Amending and Modifying the Value Added Tax Act, the Bill Amending and Modifying the Act on Tax Proceedings and Tax Administration, the Bill Amending and Modifying the Act on Contributions for Compulsory Social Insurance, the Bill Amending and Modifying the Act on Republic Administrative Fees, the Bill Amending and Modifying the Customs Act, the Customs Tariff Bill, and the Bill on the Issue of a Surcharge Postage Stamp.

The Minister of Finance, Mladjan Dinkic, presented the amendments and modifications from this package of financial legislation.

The National Assembly then concluded debate in principle on the Bill Amending and Modifying the Road Transport Act.

At the beginning of the sixth day of the session (30 June), the Chairman of the National Assembly, Predrag Markovic, informed the deputies that the Government of the Republic of Serbia had withdrawn from procedure the Competition Protection Bill, the Advertising Bill and the Ombudsman Bill. The Government has also withdrawn the Public Administration Bill and the Civil Servants Bill from National Assembly procedure.

The National Assembly then went on to discuss the Bill Amending and Modifying the Labour Act. Presenting the Bill, the Minister of Labour, Employment and Social Policy, Slobodan Lalovic, said that the amendments removed contradictions in the law relating to the treatment of bonus payment, as well as making several minor adjustments.

Deputies concluded joint discussion on the Bill Amending and Modifying the Act on Lien on Movable Property Entered into the Registry. The Minister of the Economy, Predrag Bubalo, speaking on behalf of the proposer of the Bill, addressed the Assembly, saying that the proposed amendments and modifications changed the deadline for entering court lien into the lien registry and added provisions ordering the procedure of registry entry.

In the afternoon part of the session, the National Assembly concluded discussion in principle on the Bill Amending and Modifying the Act on the Registration of Commercial Entities. Mr Bubalo explained that the proposed changes were necessary to harmonise the existing Act with the Companies Act, which was adopted later, and to extend the deadline for registering private entrepreneurs in the registry of the Commercial Registries Agency.

After the Minister of Culture, Dragan Kojadinovic, acquainted the deputies with amendments and modifications proposed to be made to the Public Information Act, the National Assembly discussed this piece of legislation in principle.

On the seventh day of the session (4 July), the National Assembly discussed in principle the Bill Amending and Modifying the Judges Act, the Bill Amending and Modifying the Public Prosecutor Act, the Bill Amending and Modifying the Act on the High Judicial Council, the Bill Amending and Modifying the Court Fees Act, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in Suppressing Organised Crime, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in War Crimes Proceedings, and the Bill on the Organisation and Powers of Public Authorities in Suppressing High Technology Crime.

On behalf of the Serbian Radical Party Deputies’ Group, deputy Zoran Krasic informed the National Assembly that deputies of the Group had withdrawn from procedure amendments submitted to the Bill Amending and Modifying the Judges Act and the Bill Amending and Modifying the Public Prosecutor Act.

The deputies then went on to discuss amendments submitted to the Deposit Insurance Bill.

On the eighth day of the session (5 July), the deputies discussed the particulars of the Deposit Insurance Agency Bill and the Bill on the Bankruptcy and Liquidation of Banks and Insurance Companies.

Continuing its session according to the set agenda, on the ninth day of the session (6 July), the National Assembly concluded discussing the particulars of the Bill Amending and Modifying the Act on Banks and Other Financial Organisations and the Bill on the Export Insurance and Financing Agency of the Republic of Serbia.

On the tenth day of the session (7 July), the National Assembly discussed the particulars of the Bill Amending and Modifying the Guarantee Fund Act, the Bill Amending and Modifying the Financial Leasing Act, and the Public Debt Bill.


At the beginning of the eleventh day of the session (11 July), the National Assembly observed a minute’s silence as a mark of respect of all victims of Skelani, Srebrenica, and Bratunac, and for the victims of the terrorist attack in London.

On the twelfth day of the session (12 July), the National Assembly concluded discussion on the particulars of the Bill Amending and Modifying the Value Added Tax Act, the Bill Amending and Modifying the Act on Tax Procedure and Tax Administration, the Bill Amending and Modifying the Customs Act, and the Customs Tariff Bill.

On the thirteenth day of the session (13 July), the National Assembly discussed the particulars of the Bill Amending and Modifying the Act on Contributions for Compulsory Social Insurance, the Bill Amending and Modifying the Republic Administrative Fees Act, the Bill on the Issue of a Surcharge Postage Stamp, and the Bill Amending and Modifying the Labour Act.

When the session resumed, on the fourteenth day (14 July), the National Assembly concluded discussing the particulars of the Bill Amending and Modifying the Act on the Lien over Movable Property Entered into the Registry, the Bill Amending and Modifying the Act on the Registration of Commercial Entities, and the Bill Amending and Modifying the Public Information Act.

As the National Assembly had discussed all items from the agenda of the session, the Chairman, Predrag Markovic, convened a Voting Day session for 10 a.m. on Friday 15 July.

On Voting Day (15 July), the National Assembly adopted, in their entirety, the Bill Amending and Modifying the Judges Act, the Bill Amending and Modifying the Public Prosecutor Act, the Bill Amending and Modifying the Act on the High Judicial Council, the Bill Amending and Modifying the Court Fees Act, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in Suppressing Organised Crime, the Bill Amending and Modifying the Act on the Organisation and Powers of Public Authorities in War Crimes Proceedings, and the Bill on the Organisation and Powers of Public Authorities in Suppressing High Technology Crime.

The Assembly went on to adopt, in their entirety, the Deposit Insurance Bill, the Deposit Insurance Agency Bill, the Bill on the Bankruptcy and Liquidation of Banks and Insurance Companies, the Bill on the Export Insurance and Financing Agency of the Republic of Serbia, the Public Debt Bill, the Bill Amending and Modifying the Insurance Act, the Bill Amending and Modifying the Act on Banks and Other Financial Organisations, the Bill Amending and Modifying the Guarantee Fund Agency, the Bill Amending and Modifying the Financial Leasing Act, and the Bill Amending the Guarantee Fund Act.

The National Assembly adopted, in their entirety, the the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by German Financial Organisation KfW to Elektroprivreda Srbije Public Enterprise, the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the European Investment Bank to Finance a Railway Reconstruction Project, the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the Government of the Republic of Poland to Finance a Project for Reconstruction of the Serbian Power Generation System, the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the European Union for Settlement of Unpaid Obligations Due from the Contract with the European Investment Bank, the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Settlement of Unpaid Obligations Due Under the Loan Granted by the European Investment Bank for Financing the Urgent Road Repair Project, the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the European Investment Bank for Financing Road Repair in the Republic of Serbia, the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the European Investment Bank for Financing European Road Project B – Serbia and Montenegro, the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the European Bank for Reconstruction and Development (future modernisation and enhancement of the air traffic control system), the Bill on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the European Bank for Reconstruction and Development (Subotica municipal infrastructure reconstruction programme), the Bill Amending and Modifying the Act on Providing Counter-Guarantees of the Republic of Serbia to Serbia and Montenegro for Obligations Arising from the Loan Granted by the European Investment Bank for Financing the Electric Power Generation and Distribution System, and the Bill on Debt Restructuring Under NFA and TDFA through Issue of Bonds of the Republic of Serbia.

The National Assembly then went on to adopt, in their entirety, the Bill Amending and Modifying the Customs Act, the Bill Amending and Modifying the Value Added Tax Act, the Bill Amending and Modifying the Act on Tax Proceedings and Tax Administration, the Bill Amending and Modifying the Act on Contributions for Compulsory Social Insurance, the Bill Amending and Modifying the Act on Republic Administrative Fees, the Customs Tariff Bill, and the Bill on the Issue of a Surcharge Postage Stamp.

Finally, the National Assembly adopted, in their entirety, the Bill Amending and Modifying the Road Transport Act, the Bill Amending and Modifying the Labour Act, the Bill Amending and Modifying the Act on Lien over Movable Property Entered into the Registry, the Bill Amending and Modifying the Act on the Registration of Commercial Entities, as well as the Bill Amending and Modifying the Public Information Act.

As the National Assembly had voted on all items from the agenda, the Chairman of the National Assembly concluded the Seventh Extraordinary Sitting of the National Assembly of the Republic of Serbia in 2005.
