Thirty-Third Sitting of the Legislative Committee

At the thirty-third sitting, held on 26 January, the Legislative Committee discussed in principle several bills from the field of health protection and environmental protection, submitted by the Government.



At the thirty-third sitting, held on 26 January, the Legislative Committee discussed in principle several bills from the field of health protection and environmental protection, submitted by the Government.

These are the Bill on the Protection against Non-Ionizing Radiation, the Bill on the Protection against Ionizing Radiation and Nuclear Safety, the Waste Management Bill, the Bill on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, the Bill on the Confirmation of the Amendments to Annex B of the Kyoto Protocol to the United Nations Framework Convention on Climate Change, the Bill on the Confirmation of the Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters and the Bill on the Confirmation of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade with amendments and modifications.

The Committee unanimously deemed the bills in line with the constitutional and legal system of the Republic of Serbia and proposed that the National Assembly adopt them in principle.

The Committee members went on to discuss the Proposal for the authentic reading of the provisions of article 31 paragraphs 1 and 2 and article 32 of the Law amending and modifying the Law on Privatisation, submitted by deputy Sreto Peric. The Committee accepted as its own the Government’s opinion, forwarded to the National Assembly, that there are no grounds for the authentic reading of the listed legal provisions.

Regarding the initiative to estimate the constitutionality of article 50 of the Law on Civil Servants, the Committee’s opinion coincided with that of the Government, that the submitted initiative is not to be accepted.

Concerning the proceedings initiated to estimate the constitutionality of article 99 paragraph 5 and article 103 paragraph 1 of the Law on Waters, the Committee came to the same opinion as the Government of the Republic of Serbia, that the proposal to estimate the constitutionality should not be accepted.

Concerning the proceedings initiated to estimate the constitutionality of article 40, article 42 paragraph 1, article 43, article 44 paragraph 2 and article 92 paragraphs 3, 4, 5 and 6 of the Law on Scientific Research Activities, the Committee established the opinion, as the Government, that the disputed provisions of said Law are in line with the Constitution of the Republic of Serbia.

The sitting was chaired by the Committee Chairman, Vlatko Ratkovic.
