Fourth Special Sitting of the National Assembly of the Republic of Serbia in 2014

National Assembly Speaker Maja Gojkovic convened the Fourth Special Sitting of the National Assembly of the Republic of Serbia in 2014 for Wednesday, 4 June 2014, starting at 10 am.


For the sitting, the National Assembly Speaker set the following agenda:

1. Commissioner for Protection of Equality 2013 Regular Annual Report, submitted by the Commissioner for Protection of Equality, accompanied by the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality;

2. Ombudsman’s 2013 Regular Annual Report, submitted by the Ombudsman, accompanied by the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government;

3. 2013 Report on the implementation of the Law on Free Access to Information of Public Importance and the Law on Personal Data Protection, submitted by the Commissioner for Information of Public Importance and the Law on Personal Data Protection, accompanied by the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government;

4. Anti-Corruption Agency 2013 Activity Report with the Report on the implementation of the National Anti-Corruption Strategy of the Republic of Serbia for the period 2013 to 2018 and the Action Plan for its implementation, submitted by the Anti-Corruption Agency, accompanied by the Conclusion Proposal of the Committeeon Finance, State Budget and Control of Public Spending and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government;

5. State Audit Institution 2013 Activity Report, submitted by the State Audit Institution, accompanied by the Conclusion Proposal of the Committeeon Finance, State Budget and Control of Public Spending;

6. Proposal of the Decision modifying the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia Parliamentary Group.

By a majority vote, the National Assembly accepted the proposal of MP Prof. Dr Vladimir Marinkovic to complete a joint single debate on items 1, 2 and 3 on the agenda, and a joint single debate on items 4 and 5 on the agenda for the sitting.

At the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the termination of the term of office of MP Miodrag Rakic, before the expiry of the term he was elected for, on the day of his death.

On the behalf of the MPs and herself, National Assembly Speaker Maja Gojkovic greeted the Head of the Political Section of the European Union Delegation to Serbia Luca Bianconi, Deputy Head of the Council of Europe Mission to Serbia Nadia Cuk and representatives of the OSCE Mission to Serbia Milos Bulie, Diel Mason and Jelena Jokanovic who watched part of the sitting from the gallery of the Grand Hall.

In the morning part of the proceedings, the National Assembly commenced the joint single debate on the Commissioner for Protection of Equality 2013 Regular Annual Report, submitted by the Commissioner for Protection of Equality, accompanied by the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality; Ombudsman’s 2013 Regular Annual Report, accompanied by the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government and the 2013 Report on the implementation of the Law on Free Access to Information of Public Importance and the Law on Personal Data Protection, submitted by the Commissioner for Information of Public Importance and the Law on Personal Data Protection, accompanied by the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government.

The representatives of the submitter of the reports, Commissioner for Protection of Equality Dr Nevena Petrusic, Ombudsman Sasa Jankovic and Commissioner for Information of Public Importance and Personal Data Protection Rodoljub Sabic provided rationale on the reports.

For the remainder of the day the National Assembly conducted the joint single debate on items 1, 2 and 3 on the agenda.

On the second day of the proceedings, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Enis Imamovic, Aleksandar Cotric, Miroslav Markicevic and Dr Blagoje Bradic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The Chair, National Assembly Speaker Maja Gojkovic apologised, on the behalf of the National Assembly and herself, to the commissioners and the citizens of Serbia for the gross oversight in the previous day’s chairing of the National Assembly sitting which prevented the commissioners to address the National Assembly in a final statement which they have the right to according to the National Assembly Rules of Procedure.

The National Assembly continued and concluded the joint single debate on items 1, 2 and 3 on the agenda.

The National Assembly went on to commence a joint single debate on items 4 and 5 on the agenda – the Anti-Corruption Agency 2013 Activity Report with the Report on the implementation of the National Anti-Corruption Strategy of the Republic of Serbia for the period 2013 to 2018 and the Action Plan for its implementation, submitted by the Anti-Corruption Agency, accompanied by the Conclusion Proposal of the Committeeon Finance, State Budget and Control of Public Spending and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government and the State Audit Institution 2013 Activity Report, submitted by the State Audit Institution, accompanied by the Conclusion Proposal of the Committeeon Finance, State Budget and Control of Public Spending.

On the behalf of the submitters, the reports were presented by Anti-Corruption Agency Director Tatjana Babic and State Audit Institution President Dragoslav Sretenovic.

Based on the Decision of the Republic Electoral Commission and at the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the verification of the term of office of MP Slobodan Homen elected from the BORIS TADIC – New Democratic Party – Greens, LSV – Nenad Canak, Together for Serbia, VMDK, Together for Vojvodina, Democratic Left of Roma Electoral List. The newly-elected MP then proceeded to take the oath of office.

For the remainder of the day the National Assembly conducted and concluded the joint single debate on items 4 and 5 on the agenda.

The National Assembly also completed a single debate on the Proposal of the Decision modifying the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia Parliamentary Group.

As the National Assembly had concluded the debate on all the items on the agenda, the Chair, National Assembly Speaker Maja Gojkovic set Thursday, 5 June 2014, as Voting Day on the items on the agenda for the Fourth Special Sitting of the National Assembly of the Republic of Serbia in 2014, starting at 4.08 pm.

Voting Day

On Voting Day, 5 June, by a majority vote, the National Assembly adopted the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality of 30 May 2014 on the reviewed Commissioner for Protection of Equality 2013 Regular Annual Report.

By a majority vote, the National Assembly also adopted the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality of 30 May 2014 and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government of 2 June 2014 on the reviewed Ombudsman’s 2013 Regular Annual Report.

By a majority vote, the MPs also adopted the Conclusion Proposal of the Committee on Human and Minority Rights and Gender Equality of 30 May 2014 and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government of 2 June 2014 on the reviewed 2013 Report on the implementation of the Law on Free Access to Information of Public Importance and the Law on Personal Data Protection.

On Voting Day, by a majority of MPs’ votes, the National Assembly also adopted the Conclusion Proposal of the Committeeon Finance, State Budget and Control of Public Spending and the Conclusion Proposal of the Committee on the Judiciary, Public Administration and Local Self-Government of 2 June 2014 on the reviewed Anti-Corruption Agency 2013 Activity Report with the Report on the implementation of the National Anti-Corruption Strategy of the Republic of Serbia for the period 2013 to 2018 and the Action Plan for its implementation.

By a majority vote, the National Assembly also adopted the Conclusion Proposal of the Committeeon Finance, State Budget and Control of Public Spending on the reviewed State Audit Institution 2013 Activity Report.

The Proposal of the Decision modifying the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia Parliamentary Group, was also adopted by a majority vote.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the Fourth Special Sitting of the National Assembly and ruled that in the case of MP Marko Djurisic’s complaint of violation of article 96 of the Rules of Procedure, said article of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Maja Gojkovic concluded the Fourth Special Sitting of the National Assembly of the Republic of Serbia in 2014.
