The Working Group for the Improvement of the Electoral Process held its fifth meeting in the National Assembly on 2 October 2024, starting at 11 am.
The meeting was chaired by Nemanja Nenadic, Chairman of the Working Group, and attended by Working Group members Ugljesa Mrdic, Ana Jakovljevic, Jelena Jerinic, Ana Krstic, Risto Kostov, Luka Pusic, Pavle Dimitrijevic and Bojan Klacar, as well as substitute members Marko Milosevic, Kristina Antic, Aleksandar Stevanovic and Vladana Jarakovic.
The meeting was also attended by National Assembly Secretary General Srdjan Smiljanic, National Assembly Deputy Secretary General Vladimir Dimitrijevic and adviser to the National Assembly Speaker Mihajlo Zivkovic.
The Chairman of the Working Group proposed the following agenda for this meeting:
- Consideration of proposals for amendments and modifications to the Law on Prevention of Corruption, related recommendations from the Final Report of the ODIHR election observation mission for local elections in the Republic of Serbia, held on 2 June 2024, and harmonisation of the text within the Working Group;
- Consideration of proposals for amendments and modifications to the Law on the Single Electoral Roll, related recommendations from the Final Report of the ODIHR election observation mission for local elections in the Republic of Serbia, held on 2 June 2024, and harmonisation of the text within the Working Group;
- Consideration of initiatives to send the recommendations to state authorities for the implementation of measures.
As at the beginning of the meeting there was no decision-making quorum, the Working Group decided, on the proposal of the Chairman, to hold the meeting without a decision-making quorum, pursuant to the National Assembly Rules of Procedure, so that the present members of the Working Group could additionally familiarise themselves with the proposed amendments to the Law on Prevention of Corruption and the Law on the Single Electoral Roll.
At the beginning, the members who were not present at the Fourth Meeting shared their opinions on the proposals presented there. Since, in the period between the Fourth and Fifth meetings, member of the Working Group MP Ugljesa Mrdic had submitted a proposal for amendments to the Law on the Single Electoral Roll and the Law on the Prevention of Corruption, he was asked to present these proposals, especially the differences in the normative solutions, if any, between these proposals and the draft prepared by the National Assembly Support Service which were discussed at the Fourth Meeting. In the exchange of opinions regarding these proposals, it was concluded that it is necessary to re-establish contact with the authorities in the Ministry of the Interior in order to resolve certain doubts regarding the keeping of records on the residence of citizens and to determine whether there is a need for changes to the law governing that matter, in connection with the revision of the Unified Voter's List. In the course of the discussion, there was no convergence of views regarding the composition and duration of the mandate of the future commission that will deal with the revision of the Single Electoral Roll, and new controversial issues regarding the powers and tasks of that commission arose. It was agreed that an informal working meeting in a smaller format would be held within a few days, where the interested members of the Working Group would harmonise their positions regarding the working version of the draft law amending and modifying the Law on the Single Electoral Roll.
The members of the Working Group went on to discuss the recommendations from the final report of the ODIHR on the local elections held on 2 June 2024 and compared their content with the recommendations published by the ODIHR after the previous elections, especially the recommendations related to the two laws which were the subject of discussion.
Working Group member MP Risto Kostov repeated his proposal from the meeting between the members of the Working Group and the ODIHR delegation on 25 September 2024, to somehow initiate that the ODIHR sends a recommendation that would refer to the protection of the rights of Serbs in Kosovo- Metohija to vote in the elections conducted by the Republic of Serbia.
Among the new ODIHR recommendations, the Chairman highlighted the one that requires a public official, who is a candidate in the elections, to "resign" their post and suggested that the solution be formulated in a different way, because "resigning" would not have the desired effects. In this context, the proposal of MP Ugljesa Mrdic was debated, that the restriction on the performance of public functions during the election campaign be tied to the expiration of the deadline for running in the elections, as well as the modalities of limiting the activities of public officials during the election campaign. It was emphasised that the basic idea is not to prohibit persons performing public functions from participating in the election campaign, but to prevent public officials from campaigning "from the armchair of a public official" instead of as party activists, that is, party officials. In the end, the Chairman stated that it is definitely necessary to carry out additional consultations on the already proposed solutions for changes to the Law on Prevention of Corruption in light of the ODIHR recommendations from June 2024, which are not addressed by the proposed draft amendments to said law.
