Fourth Sitting of the Committee on the Judiciary, Public Administration and Local Self-Government

At the sitting held on 16 December 2020, the Committee on the Judiciary, Public Administration and Local Self-Government considered the Ombudsman’s 2019 Regular Annual Report and the Report on the implementation of the Law on Free Access to Information of Public Importance and the Law on Personal Data Protection in 2019.


The Ombudsman’s 2019 Regular Annual Report was presented by Ombudsman Zoran Pasalic. He said that the Report provides a general assessment of the exercise of citizens' rights in 2019, Ombudsman’s recommendations, opinions and legislative initiatives, as well as exercise of rights of particularly vulnerable groups, children, LGBT people, people with disabilities and the elderly, minorities, and the national torture prevention mechanism. The Report also covers people’s civil, economic/property and social and cultural rights.

Pasalic said that in 2019, 10,862 citizens addressed the Ombudsman, and the body received 3,276 complaints of civil rights violations. In the course of 2019, the Ombudsman issued a total of 934 recommendations to the Administration bodies, the largest number of which, 118, relate to the Administration department.

Having reviewed the Ombudsman’s 2019 Regular Annual Report, the Committee adopted the following Conclusion:

  • The National Assembly concludes that in the 2019 Regular Annual Report, through a comprehensive presentation of the Ombudsman’s activities in the exercise of its constitutional and legal competencies, the Ombudsman gave a general assessment of the state and quality of exercising and protecting citizens' rights before state bodies, the state of public administration and sector as a whole, pointing to the necessary systemic changes through the building and strengthening of institutions with the aim of improving the rule of law, respecting human and minority rights and the realization of citizens' rights.
  • The National Assembly, based on the Ombudsman’s assessment of the position of citizens in relation to administrative bodies, recommends that the Government continue with the constant: supervision over the work of court administration, public enforcement officers and consistent application of regulations governing actions on complaints about their work; improving communication with citizens; monitoring the consistent application of regulations in all areas; analyzing the effects of law enforcement, in order to efficiently and legally exercise the rights of citizens and improve the mechanisms for the protection of their rights.
  • The National Assembly calls on the Government to continuously inform the National Assembly on the implementation of these conclusions.
  • This conclusion shall be published in the "Official Gazette of the Republic of Serbia".
The Report on the implementation of the Law on Free Access to Information of Public Importance and the Law on Personal Data Protection in 2019 was presented by the secretary general of the Commissioner for Information of Public Importance and Personal Data Protection Support Service Marinko Radic. He said that thought the right to free access to information of public importance was used to a large extent in 2019, it was still difficult to exercise on a large scale without the intervention of the Commissioner. He pointed out that this right was most often exercised by citizens, followed by civic associations, media representatives, government bodies, political parties, lawyers, business entities and others. The Report states that applicants had most difficulties in obtaining information regarding the spending of budgetary funds, public procurement and other issues concerning the disposal of public funds, public property records and similar. 6,760 cases were filed in 2019, most of which, 5,275, were complaints related to the spending of budgetary funds.

Having reviewed the Report on the implementation of the Law on Free Access to Information of Public Importance and the Law on Personal Data Protection in 2019, the Committee adopted the following Conclusion:

  • The National Assembly notes that in the Report on the implementation of the Law on Free Access to Information of Public Importance and the Law on Personal Data Protection in 2019, the Commissioner for Information of Public Importance and Personal Data Protection provided an overview of the situation in the field of free access to information of public importance and personal data protection.
  • The National Assembly encourages the Government to intensify activities on appropriate normative amendments, especially amendments to the Law on Free Access to Information of Public Importance, as well as to improve the strategic framework in the field of personal data protection.
  • The National Assembly calls on the Government to regularly submit a report to the National Assembly on the implementation of these conclusions.
  • This conclusion shall be published in the "Official Gazette of the Republic of Serbia".
The Committee moved to submit the adopted conclusion proposals to the National Assembly under urgent procedure.
