Fourth Sitting of the Committee on the Judiciary, Public Administration and Local Self-Government

At the sitting held on 27 September, the members of the Committee on the Judiciary, Public Administration and Local Self-Government considered the High Judicial Council 2015 Activity Report.


Presenting the Report, High Judicial Council Vice-President Miroljub Tomic said that in 2015 the High Judicial Council operated in an incomplete composition, with nine instead of 11 members. The Lawyers Chamber has not nominated a member to represent it in the High Judicial Council to date, and the trial against one member, removed from the High Judicial Council, is still in progress. In the meantime, the electoral commission of the High Judicial Council adopted a decision on five electoral members so after the election in the National Assembly the High Judicial Council now has 10 members, said Tomic. He stated that, in line with the Law amending and modifying the Law on the High Judicial Council, the sessions of the High Judicial Council are public and the Council had transparently published all of its decisions. Speaking of the implementation of regulations, Tomic said that several rulebooks have been amended, from the rulebook on the assessment of the work of judges and court presidents to the rulebook on disciplinary accountability, concerning the election of judges and boosting their disciplinary accountability. In 2015 the High Judicial Council had 28 regular and seven telephone sessions, elected 128 judges, dismissed one court president, and in the period 2013-2015 318 judges left judicial office, while the High Judicial Council ruled in 13 cases in the second degree.

Following a debate the Committee members accepted the High Judicial Council 2015 Activity Report by majority vote and forwarded it to the National Assembly for consideration and ruling.

The Committee then went on to consider five decision proposals for the election of judges to judicial office for the first time, submitted by the High Judicial Council.

High Judicial Council Vice-President Miroljub Tomic elaborated on the decision proposals on the behalf of the submitter, saying that the High Judicial Council has submitted candidate proposals for the election of judges to judicial office for the first time for most of the courts in Serbia. He added that the High Judicial Council assessed the needs of the courts, called a competition and implemented the procedure for the nomination of candidates for the election to judicial office for the first time. The High Judicial Council spent 91 days interviewing the 1,225 applicants before nominating the candidates to the National Assembly.

Following a debate the Committee members accepted the decision proposals for the election of judges to judicial office for the first time, submitted by the High Judicial Council.

By majority vote, the Committee members also accepted the Proposal of the Decision on the termination of office of President of the Commercial Court in Belgrade and the Proposal of the Decision on the termination of office of President of the Basic Court in Krusevac and forwarded them to the National Assembly by urgent procedure.

The sitting chaired by Committee Chairman Petar Petrovic and attended by the following Committee members and deputy members: Slavisa Bulatovic, Djordje Komlenski, Dusan Petrovic, Jovan Palalic, Sreto Peric, Zarko Micin, Balint Pasztor, Biljana Pantic Pilja, Dr Aleksandar Martinovic, Vjerica Radeta, Dusan Pavlovic, Marko Parezanovic, Mihailo Jokic and Miletic Mihajlovic.
