Fifth Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2019

The Speaker of the National Assembly of the Republic of Serbia Maja Gojkovic convened the Fifth Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2019, for Tuesday, 14 May, starting at 10 am.


Before the agenda was adopted, the heads i.e. authorised representatives of the parliamentary groups, MPs Prof. Dr Vojislav Seselj, Fatmir Hasani, Dr Predrag Jelenkovic, Novica Toncev, Marijan Risticevic and Aleksandar Markovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly adopted the following agenda:

  1. Bill amending and modifying the Criminal Code, submitted by the Government;
  2. Bill amending and modifying the Criminal Procedure Code, submitted by the Government;
  3. Bill on Prevention of Corruption, submitted by the Government;
  4. Bill amending and modifying the Law on Seizure and Confiscation of Proceeds from Crime, submitted by the Government;
  5. Bill amending and modifying the Law on Execution of Criminal Sanctions, submitted by the Government;
  6. Bill on the Confirmation of the Preferential Buyer Credit Loan Agreement on Project of Modernization and Reconstruction of Hungarian-Serbian Railway Connection on the Territory of the Republic of Serbia, for Section Novi Sad-Subotica-State Border (Kelebija) between the Government of the Republic of Serbia Represented by the Ministry of Finance as Borrower and the Export-Import Bank of China as Lender, submitted by the Government;
  7. Bill on the Confirmation of the Preferential Buyer Credit Loan Agreement on Construction of Highway E-763, Section Preljina-Pozega Project between the Government of the Republic of Serbia Represented by the Ministry of Finance as Borrower and the Export-Import Bank of China as Lender, submitted by the Government;
  8. Bill on the Confirmation of the Partnership for Local Development Finance Contract between the Republic of Serbia and the European Investment Bank, submitted by the Government;
  9. Bill on the Confirmation of the Municipal Infrastructure Resilience Framework Finance Contract between the Republic of Serbia and the European Investment Bank, submitted by the Government;
  10. Bill on the Confirmation of the Loan Agreement (Tax Administration Modernization Project) between the Republic of Serbia and the International Bank for Reconstruction and Development, submitted by the Government;
  11. Bill on the Confirmation of the Loan Agreement (Western Balkans Trade and Transport Facilitation Project using the Multiphase Programmatic Approach) between the Republic of Serbia and the International Bank for Reconstruction and Development, submitted by the Government;
  12. Bill on the Confirmation of the Loan Agreement (Enabling Digital Governance Project) between the Republic of Serbia and the International Bank for Reconstruction and Development, submitted by the Government;
  13. Bill on the Confirmation of the Framework Loan Agreement LD 1981 (2018) between the Council of Europe Development Bank and the Republic of Serbia Public Sector Financing Facility - Upgrade of Healthcare Infrastructure in Serbia, submitted by the Government;
  14. Proposal of the Decision on the election of court presidents, submitted by the High Judicial Council; and
  15. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council.
The National Assembly accepted the proposal of MP Maja Gojkovic to complete a joint debate in principle and single debate on items 1, 2, 3, 4, 5, 14 and 15 on the agenda, and joint single debate on items 6, 7, 8, 9, 10, 11, 12 and 13 on the agenda.

The National Assembly proceeded to commence the joint debate in principle and single debate on items 1, 2, 3, 4, 5, 14 and 15 viz. the Bill amending and modifying the Criminal Code, Bill amending and modifying the Criminal Procedure Code, Bill on Prevention of Corruption, Bill amending and modifying the Law on Seizure and Confiscation of Proceeds from Crime, Bill amending and modifying the Law on Execution of Criminal Sanctions, Proposal of the Decision on the election of court presidents and the Proposal of the Decision on the election of judges to judicial office for the first time.

The proposed documents were presented by Minister of Justice Nela Kuburovic and High Judicial Council member Aleksandar Pantic as representatives of the submitters.

The National Assembly conducted the joint debate in principle and single debate on items 1, 2, 3, 4, 5, 14 and 15 for the remainder of the workday.
On the second day of the proceedings, 15 May, the National Assembly continued and completed the joint debate in principle and single debate on items 1, 2, 3, 4, 5, 14 and 15.

The bills were presented by Minister of Labour, Employment, Veteran and Social Affairs Zoran Djordjevic and State Secretary at the Ministry of Finance Jelena Tanaskovic as representatives of the submitter.

The National Assembly conducted the joint single debate on items 6, 7, 8, 9, 10, 11, 12 and 13 for the remainder of the workday.

On the third day of the proceedings, 16 May, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Aleksandar Seselj, Mirjana Dragas, Milija Miletic and Miodrag Linta requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly continued and, by the end of the workday, completed the joint single debate on items 6, 7, 8, 9, 10, 11, 12 and 13.

On the fourth day of the proceedings, 17 May, the National Assembly commenced a debate in detail on item 1 on the agenda - Bill amending and modifying the Criminal Code.

In the course of the day the National Assembly concluded a debate in detail on items 1 and 2 on the agenda and commenced a debate in detail on the Bill on Prevention of Corruption.

The MPs conducted the debate in detail on item 3 on the agenda for the remainder of the day.

On the fifth day of the proceedings, 20 May, the National Assembly conducted and concluded a debate in detail on items 3, 4 and 5 on the agenda.

As the National Assembly had completed a debate in principle and in detail on all the items on the agenda, the Chair, National Assembly Deputy Speaker Prof. Dr Vladimir Marinkovic set Tuesday, 21 May, as Voting Day on all the items on the agenda of the Fifth Regular Session of the National Assembly of the Republic of Serbia in 2019, starting at 10 am.

Voting Day

On Voting Day, 21 May 2019, the MPs ruled on the bills and decision proposals on the agenda.

Before commencing the voting, National Assembly Speaker Maja Gojkovic greeted, on the behalf of the MPs and herself, Igor Juric, the founder of the “Tijana Juric” foundation, and Ivan Jovanovic, journalist of Blic, who watched the adoption of the Bill amending and modifying the Criminal Code from the gallery of the Grand Hall. The Speaker reminded the attending that the “Tijana Juric” foundation, in cooperation with the Blic editorial board, had launched the initiative to amend the Criminal Code, by collecting 158,460 signatures.

The National Assembly proceeded to adopt the following, by majority vote:

  1. Bill amending and modifying the Criminal Code, submitted by the Government;
  2. Bill amending and modifying the Criminal Procedure Code, submitted by the Government;
  3. Bill on Prevention of Corruption, submitted by the Government;
  4. Bill amending and modifying the Law on Seizure and Confiscation of Proceeds from Crime, submitted by the Government;
  5. Bill amending and modifying the Law on Execution of Criminal Sanctions, submitted by the Government;
  6. Bill on the Confirmation of the Preferential Buyer Credit Loan Agreement on Project of Modernization and Reconstruction of Hungarian-Serbian Railway Connection on the Territory of the Republic of Serbia, for Section Novi Sad-Subotica-State Border (Kelebija) between the Government of the Republic of Serbia Represented by the Ministry of Finance as Borrower and the Export-Import Bank of China as Lender, submitted by the Government;

  14. Proposal of the Decision on the election of court presidents, submitted by the High Judicial Council; and
  15. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council.
As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Maja Gojkovic concluded the Fifth Regular Session of the National Assembly of the Republic of Serbia in 2019.
