55th Sitting of the Committee on Constitutional and Legislative Issues

At the sitting held on 10 December, the members of the Committee on Constitutional and Legislative Issues deliberated on the amendments submitted to the Bills on the agenda of the Fifth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2017.


Before moving onto the agenda the Committee Chairman proposed to, due to technical reasons, deliberate on item 3 last, which the Committee members accepted by majority vote.

Out of the 35 amendments submitted to the Bill amending the Republic of Serbia 2017 Budget Law, the Committee rejected the amendment to Article 1 as incomplete, while the rest were found to be compliant with the Constitution and legal system of the Republic of Serbia.

Out of the 418 amendments submitted to the Bill amending and modifying the Budget System Law, the Committee rejected the amendment to Article 1 as incomplete, while the rest were found to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee members found the 58 amendments submitted to the Bill amending and modifying the Value Added Tax Law, 71 amendments submitted to the Bill amending and modifying the Corporate Income Tax Law, 185 amendments submitted to the Bill amending and modifying the Personal Income Tax Law, 47 amendments submitted to the Bill amending and modifying the Law on Compulsory Social Insurance Contributions, 85 amendments submitted to the Bill amending and modifying the Law on Republic Administrative Fees, 32 amendments submitted to the Bill amending and modifying the Law on Public Property, 16 amendments submitted to the Bill amending and modifying the Law on Payment Deadlines in Commercial Transactions and the 8 amendments submitted to the Bill on Preventing Money Laundering and Financing of Terrorism to be compliant with the Constitution and legal system of the Republic of Serbia.

Out of the eight amendments submitted to the Bill amending and modifying Law on Restrictions on Disposal of Property with the Aim of Preventing Terrorism, the Committee rejected the amendment to Article 12 as incomplete, while the rest were found to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee members also found the two amendments submitted to the Bill amending and modifying the Law on the Settlement of Public Debt of the Republic of Serbia arising from Unpaid Citizens’ Foreign Exchange Savings Deposited in Banks with Headquarters on the Territory of the Republic of Serbia and Branch Offices on the Territory of Former SFRY Republics, 118 amendments submitted to the Bill amending and modifying the Law on Bankruptcy, 75 amendments submitted to the Bill on Financial Support to Families with Children, 17 amendments submitted to the Bill amending and modifying the Labour Law, 18 amendments submitted to the Bill amending and modifying the Law on Employment and Unemployment Insurance and the 9 amendments submitted to the Bill amending and modifying the Law on Employment of Foreigners to be compliant with the Constitution and legal system of the Republic of Serbia.

Of the 86 amendments submitted to the Bill on Public Service Employees, the Committee found the amendment to Article 153 not to comply with the Constitution and legal system of the Republic of Serbia, while the remaining 85 were found to be compliant with the Constitution and legal system of the Republic of Serbia.

Reviewing the amendments submitted to the Bill amending and modifying the Law on Employees in Autonomous Provinces and Local Self-Government Units, the Committee members rejected the amendment to Article 1 as incomplete, while the remaining 15 were found to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found the 65 amendments submitted to the Bill on Salaries of Civil Servants and Employees in Bodies of Autonomous Provinces and Local Self-Government Units, the 12 amendments submitted to the Bill amending and modifying the Law on Salary System in Public Sector and the four amendments submitted to the Bill amending the Law on Organization of Courts to be compliant with the Constitution and legal system of the Republic of Serbia.

Of the 917 amendments submitted to the Republic of Serbia 2018 Budget Bill, with its accompanying Proposal of the Decision to grant consent to the Republic Pension and Disability Insurance Fund 2018 Financial Plan, Proposal of the Decision to grant consent to the Republic Health Insurance Fund 2018 Financial Plan, Proposal of the Decision to grant consent to the National Employment Service 2018 Financial Plan and the Proposal of the Decision to grant consent to the Fund for Social Insurance of Military Insured 2018 Financial Plan, the Committee rejected the amendment to Article 1 as incomplete, 43 were found not to comply with the Constitution and legal system of the Republic of Serbia, while the rest were found to be compliant with the Constitution and legal system of the Republic of Serbia.

The sitting was attended by representatives of the Ministry of Finance and Ministry of Justice.
