47th Sitting of the Committee on Constitutional and Legislative Issues

At the sitting held on 7 March, the Committee on Constitutional and Legislative Issues considered the bills on the agenda for the First Sitting of the First Regular Session of the National Assembly in 2013, in principle.


The Committee unanimously declared the Bill on Efficient Energy Use, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Russian Federation on Natural Gas Delivery from the Russian Federation to the Republic of Serbia, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Russian Federation Granting a State Export Credit to the Government of the Republic of Serbia, Bill on the Confirmation of the Guarantee Agreement between the Republic of Serbia and the Kuwait Fund for Arab Economic Development (Belgrade Center Railway Station Project – Phase I), Bill on the Confirmation of the Cooperation Agreement between the Government of the Republic of Serbia an the Government of the United Arab Emirates, Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the United Arab Emirates, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the United Arab Emirates on Avoidance of Double Taxation with respect to Taxes on Income and the Bill on the Confirmation of the Agreement between the Republic of Serbia and the United Arab Emirates on Reciprocal Stimulation and Protection of Investments, compliant with the Constitution and legal system of the Republic of Serbia.

The Committee did not vote on the Bill on Special Conditions for Registry of Ownership Rights for Buildings Constructed without a Construction Permit and will do so at the next sitting.

In the continuation, by a majority of votes, the Committee formulated the text of the response to be sent to the Constitutional Court as regards the procedure to ascertain the unconstitutionality and non-compliance with the ratified international treaty of the provisions of article 20, paragraph 12 and 13, of the Expropriation Law, as well as the procedure to ascertain the unconstitutionality of the provision of article 39, paragraph 2, of the Law on Protection and Sustainable Use of the Fish Fund.

The Committee also formulated the text of the response to the Constitutional Court as regards the three initiatives to launch procedures to assess the constitutionality of the provision of article 142, paragraph 4, and article 146, paragraph 4 and 5, of the Medical Insurance Law, article 38, paragraph 4, of the Law on Ministries and the provisions of articles 6 and 27, of the Law amending and modifying the Road Transport Law.

The Committee formulated the text of the response to the Constitutional Court as regards the initiative to launch a procedure to assess the constitutionality and compliance with ratified international treaties of the provisions of article 1, article 6, paragraph 2 and 3, articles 8 and 10, article 14, paragraph 1, article 15, paragraph 1, article 41, paragraph 3 and article 66, of the Law on Restitution of Confiscated Property and Indemnification.

At the end of the sitting, Committee member Srdjan Mikovic informed the Committee that the work on the text of the Legislative Policy Resolution Proposal, which should soon enter assembly procedure, had been completed.

The sitting was chaired by MA Vladimir Cvijan, Committee Chairman.
