26th Sitting of the Committee on Constitutional and Legislative Issues

At the sitting held on 24 July 2023, the members of the Committee on Constitutional and Legislative Issues considered the 24 bills in detail.


Of the 27 amendments submitted to the Bill amending the Building Legalisation Law, the Committee on Constitutional and Legislative Issues found 24 to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee on Constitutional and Legislative Issues rejected as incomplete the one amendment submitted to the Bill on the Confirmation of the Sectoral Agreement between the Government of the Republic of Serbia and the European Commission Setting Out Provisions for the Management and Implementation of Union Financial Assistance to Serbia Under the Rural Development Programme of the Instrument For Pre-Accession Assistance (IPARD III).

Of the 37 amendments submitted to the Bill on the Temporary Register of Mothers and Other Persons for the Payment of Financial Assistance, the Committee on Constitutional and Legislative Issues found 36 to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found all 20 of the amendments submitted to the Bill amending and modifying the Law on Financial Support to Families with Children to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee rejected one and found the remaining eight amendments submitted to the Bill amending and modifying the Law on Air Transport to be compliant with the Constitution and legal system of the Republic of Serbia.

Of the 13 amendments submitted to the Bill amending and modifying the Energy Law, the Committee found 12 to be compliant with the Constitution and legal system of the Republic of Serbia.

Of the 253 amendments submitted to the Bill amending and modifying the Law on Planning and Construction, the Committee rejected three as incomplete and found the remaining 250 to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found all 14 of the amendments submitted to the Bill amending and modifying the Law on Railway to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found all 14 of the amendments submitted to the Bill on the Interoperability of the Railway System to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found all 19 of the amendments submitted to the Bill amending and modifying the Law on Employment of Foreigners to be compliant with the Constitution and legal system of the Republic of Serbia.

Of the 29 amendments submitted to the Bill amending and modifying the Law on Foreigners, the Committee rejected two as incomplete and found the remaining 27 to be compliant with the Constitution and legal system of the Republic of Serbia.

Of the three amendments submitted to the Bill on the Termination of the Validity of the Law on Special Procedures for the Implementation of the Project of Construction and Reconstruction Line Infrastructure Structures of Particular Importance to the Republic of Serbia, the Committee found two to be compliant with the Constitution and legal system of the Republic of Serbia.

Of the 14 amendments submitted to the Bill amending the Law on Special Conditions for the Realisation of the Housing Construction Project for Members of the Security Forces, the Committee found 13 to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found both of the amendments submitted to the Bill on the Confirmation of the Loan Agreement (First Serbia Green Transition Programmatic Development Policy Loan) between the Republic of Serbia and the International Bank for Reconstruction and Development, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee also found both of the amendments submitted to the Bill on the Confirmation of the Loan Agreement (Improving Public Financial Management for the Green Transition Operation) between the Republic of Serbia and the International Bank for Reconstruction and Development, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found both of the amendments submitted to the Bill on the Confirmation of the Loan Agreement (Project Science) between the Republic of Serbia and the European Bank for Reconstruction and Development, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee also found both of the amendments submitted to the Bill on the indebtedness of the Republic of Serbia with Banca Intesa AD Beograd for the financing of the Ruma-Sabac-Loznica Road Construction Project, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found all three of the amendments submitted to the Bill on the Confirmation of the Facility Agreement for a €300,000,000 term loan facility between the Republic of Serbia represented by the Government of the Republic of Serbia Acting by and through the Ministry of Finance arranged by Merrill Lynch International with the Financial Institutions listed in Schedule 1 as Original Lenders and Global Loan Agency Services Limited acting as Agent, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found both of the amendments submitted to the Bill on the Confirmation of the Framework Loan Agreement LD 2114 (2022) between the Council of Europe Development Bank and the Republic of Serbia Prison Facilities in Krusevac and Sremska Mitrovica - Project Loan, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee also found both of the amendments submitted to the Bill Granting Guarantee by the Republic of Serbia in favour of OTP Banka Srbija AD Novi Sad and Banca Intesa a.d. Beograd under the debt of Elektrodistribucija Srbije d.o.o. Beograd, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee found both of the amendments submitted to the Bill on the Confirmation of the Loan Agreement Catalyzing Long Term Finance through Capital Markets Project between the Republic of Serbia and International Bank for Reconstruction and Development, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee also found both of the amendments submitted to the Bill on the Confirmation of the Framework Loan Agreement LD 1981 ADD 1 (2022) between the Council of Europe Development Bank and the Republic of Serbia - Health Public Sector Financing Facility (PFF), to be compliant with the Constitution and legal system of the Republic of Serbia.

The MPs had submitted two amendments to the Bill on the Confirmation of the Amendment Agreement Relating to the EUR 400,000,000 MIGA Facility Agreement, dated 10 December 2021 between the Republic of Serbia represented by the Government of the Republic of Serbia acting by and through the Ministry of Finance as Borrower and J.P. MORGAN AG as agent and JPMORGAN CHASE BANK, N.A., London Branch as Initial Mandated Lead Arranger and Credit Agricole Corporate and Investment Bank, Raiffeisen Bank International AG and Santander Bank N.A. as mandated lead arrangers and Caixabank, S.A. and UBS Switzerland AG as Lead Arrangers And Banco Santander, S.A., Caixabank, S.A., Credit Agricole Corporate and Investment Bank, JPMorgan Chase Bank, N.A., London Branch, Raiffeisen Bank International AG and UBS Switzerland AG as original lenders, relating to a Senior Unsecured Term Loan Facility to Finance the Provision of Certain Construction Services by Bechtel Enka UK Limited, operating in Serbia through Bechtel Enka UK Limited Ogranak Beograd to Koridori Srbije D.O.O. Beograd in relation to the construction of the Infrastructure Corridor E-761 Highway Section Pojate-Preljina (The Morava Corridor), which the Committee found to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee also found both of the amendments submitted to the Bill on the indebtedness of the Republic of Serbia with OTP Banka Srbija AD Novi Sad for the financing of the high-speed road construction Project, section Pozarevac-Golubac (Danube highway), to be compliant with the Constitution and legal system of the Republic of Serbia.
