20th Sitting of the Health and Family Committee

At the sitting held on 10 March, the members of the Health and Family Committee discussed how best to approach the realisation of the conclusion of the 19th Committee sitting: vaccination requires a concentrated effort of the state and society, that includes regulating the legislation on the matter i.e. harmonising Article 25 of the Law on Protection of Citizens against Infectious Diseases with Article 15 of the Patients’ Rights Law.


The Committee noted that there have been problems in the application of said provisions which is why it is initiating their amendment i.e. rapprochement.
It was proposed that Article 25 of the Law on Protection of Citizens against Infectious Diseases be amended to include the following: “Compulsory vaccination from paragraph 2 of the article does not require written consent of the patient or legal representative of the child”.
The Committee members also proposed that Article 25, paragraph 10 of the Law be amended as follows:
“Immunisation from paragraph 1 of the article is performed by an MD who can, after examination of the person who is to be immunised, institute a temporary, or propose that a Team of Experts institute a permanent contraindication to vaccination”.
The Committee members also proposed that a new paragraph, paragraph 11, be added after paragraph 10 stating: “Records on immunisations conducted are to be kept by the MD performing the immunisations, in line with the law”.
The Committee believes that the explanation of some of the terms employed in the Law in section General Provisions should define the term “immunisation” in view of Article 15, paragraph 2 of the Patients’ Rights Law, which would explain that immunisation is a preventive, and not a diagnostics or treatment measure.
The Committee members noted that it is the Committee’s position that the Government should, pursuant to articles 123 and 124 of the Constitution, submit to the National Assembly appropriate amendments and modifications to the Law on Protection of Citizens against Infectious Diseases.

The sitting was chaired by Prof. Dr Slavica Djukic Dejanovic, Committee Chairperson.
