10th Sitting of the Committee on Constitutional and Legislative Issues

At the sitting held on 18 November, the Committee on Constitutional and Legislative Issues deliberated on the amendments submitted to items 1 through 4 on the agenda for the Fourth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2016.


To the Bill on Preventing Domestic Violence, submitted by the Government, the MPs had submitted 153 amendments. The Committee found four non-compliant with the Constitution and the legal system of the Republic of Serbia – the amendment to Article 16 submitted by Gorica Gajic, to Article 16 and Article 18 submitted by Borislav Kovacevic, and to Article 31 jointly submitted by Velimir Stanojevic and Dubravka Filipovski. By majority vote, the Committee members found the rest of the amendments compliant with the Constitution and the legal system of the Republic of Serbia.

The Committee on the Judiciary, Public Administration and Local Self-Government had submitted an amendment to Article 13 of the Bill on Preventing Domestic Violence which the Committee on Constitutional and Legislative Issues found to be compliant with the Constitution and the legal system of the Republic of Serbia.

The MPs had submitted 71 amendments to the Bill amending and modifying the Criminal Code, and the Committee found 70 of them to comply with the Constitution and the legal system of the Republic of Serbia, while the amendment to Article 40 jointly submitted by Nenad Canak, Marinika Tepic, Olena Papuga and Nada Lazic was rejected as incomplete.

Out of the 43 amendments submitted to the Bill on Organisation and Jurisdiction of Government Authorities in Suppression of Organised Crime, Terrorism and Corruption, the Committee found 41 to comply with the Constitution and the legal system of the Republic of Serbia, while two amendments were found not to: the amendment to Article 7 jointly submitted by Marko Djurisic, Miroslav Aleksic, Goran Bogdanovic, Nenad Konstantinovic and Zdravko Stankovic, and amendment to Article 18 jointly submitted by Srdjan Nogo, Bosko Obradovic, Dr Dragan Vesovic, Marija Janjusevic, Dr Ivan Kostic and Zoran Radojicic.

The Committee found all 39 of the amendments submitted to the Bill amending and modifying the Law on Seizure and Confiscation of Proceeds from Crime, compliant with the Constitution and the legal system of the Republic of Serbia.

The sitting was chaired by Committee Chairman Djordje Komlenski, and attended by the following Committee members and deputy members: Miroljub Stankovic, Vesna Markovic, Vesna Nikolic Vukajlovic, Krsto Janjusevic, Srbislav Filipovic, Bojan Torbica, Bajro Gegic, Jelena Zaric Kovacevic and Ljupka Mihajlovska.
