Seventh Sitting of the Committee on Constitutional and Legislative Issues

At the sitting held on 2 December 2022, the members of the Committee on Constitutional and Legislative Issues considered 23 items on the agenda.


The Committee considered the Republic of Serbia 2023 Budget Bill, with its accompanying Proposal of the Decision to grant consent to the Republic Pension and Disability Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Republic Health Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Fund for Social Insurance of Military Insured 2023 Financial Plan and the Proposal of the Decision to grant consent to the National Employment Service 2023 Financial Plan, submitted by the Government, in principle; Bill on the Republic of Serbia 2021 Budget Final Financial Statement, submitted by the Government, in principle; Bill amending and modifying the Budget System Law, submitted by the Government, in principle; Bill amending and modifying the Law on Tax Procedure and Tax Administration, submitted by the Government, in principle; Bill amending and modifying the Property Taxes Law, submitted by the Government, in principle; Bill amending and modifying the Personal Income Tax Law, submitted by the Government, in principle; Bill amending and modifying the Value Added Tax Law, submitted by the Government, in principle; Bill amending and modifying the Law on Compulsory Social Insurance Contributions, submitted by the Government, in principle; Bill amending and modifying the Law on Republic Administrative Fees, submitted by the Government, in principle; Bill amending and modifying the Customs Law, submitted by the Government, in principle; Bill amending and modifying the Law on Deadlines for Settlement of Financial Liabilities in Commercial Transactions, submitted by the Government, in principle; Bill amending and modifying the Law on Electronic Invoicing, submitted by the Government, in principle; Bill amending and modifying the Law on Fiscalisation, submitted by the Government, in principle; Bill of the Loan of the Republic of Serbia with NLB Komercijalna banka AD Beograd for the funding of Project Construction of IB-Class State Road, Expressway Section: Highway E-75 Belgrade – Nis (“Pozarevac” interchange) – Pozarevac (roundabout) – Veliko Gradiste – Golubac (Danube highway), submitted by the Government, in principle; Bill on the Confirmation of the Loan Agreement (Scaling-Up Residential Clean Energy Project) between the Republic of Serbia and the International Bank for Reconstruction and Development, submitted by the Government, in principle; Bill amending and modifying the Law on Pension and Disability Insurance, submitted by the Government, in principle; Bill on the Confirmation of the Financial Framework Partnership Agreement between the European Commission and the Republic of Serbia Represented by the Government of the Republic of Serbia on Specific Arrangements for Implementation of Union Financial Assistance to the Republic of Serbia under the Instrument of Pre-Accession Assistance (IPA III), submitted by the Government, in principle; as well as the Bill on the Confirmation of the Framework Protocol on Financial and Technical Cooperation between the Government of the Republic of Serbia and the Government of the Kingdom of Spain in the Field of Infrastructure Projects and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of Hungary on Friendly Relations and Cooperation in the Field of Strategic Partnership, submitted by the Government, finding them all to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee also found the Proposal of the Decision to grant consent to the Decision amending and modifying the Republic Pension and Disability Insurance Fund 2022 Financial Plan, submitted by the Government, Proposal of the Decision to grant consent to the Decision amending the National Employment Service 2022 Financial Plan, submitted by the Government and the Proposal of the Decision to grant consent to the Decision amending the Fund for Social Insurance of Military Insured 2022 Financial Plan, submitted by the Government, to be compliant with the Constitution and legal system of the Republic of Serbia.

The Committee went on to forward a response to the Constitutional Court regarding the two initiatives to launch proceedings to determine the constitutionality of the provisions of Article 280e paragraphs 3 and 4 of the Insurance Law and Article 61, paragraph 6, item 2) of the Law on Privatisation prepared in accordance with the opinion of the Government of the Republic of Serbia.

The sitting was chaired by Committee Chairperson Jelena Zaric Kovacevic, and attended by the following Committee members and deputy members: Dragan Nikolic, Dubravka Kralj, Milica Nikolic, Vesna Nedovic, Sanja Jefic Brankovic, Marko Mladenovic, Sanja Lakic, Nenad Mitrovic, Dr Zika Bujuklic, Nebojsa Cakic, Olja Petrovic, Ljubinko Djurkovic and Zvonimir Stevic.
