36th Sitting of the Security Services Control Committee

At the 36th sitting, held on 21 February 2020, the Security Services Control Committee considered and unanimously adopted the Inspector General of the Ministry of Defence Services Report on the extraordinary inspection of the Military Security Agency concerning the legality of the implementation of special procedures and measures for the collection of confidential data.

Acting on the Committee’s request the Inspector General conducted the extraordinary inspection of the Military Security Agency concerning the legality of the implementation of special procedures and measures for the collection of confidential data and special evidentiary actions, the potential implementation of which might reveal communication content.

In the course of the extraordinary inspection the Inspector General ascertained that the Military Security Agency did not implement special procedures and measures which might reveal information from personal communication against former Minister of Defence Mr. Dragan Sutanovac and editor-in-chief of “Nedeljnik” Mr. Veljko Lalic. The investigation did not find any illegal implementation of special procedures and measures or any abuse in that sense i.e. it was found that the measures were applied strictly in accordance with the law and duly recorded.

In view of the fact that there have been some public allegation directly accusing the Minister of Defence of the Republic of Serbia of illegal insight into the electronic communication of one media and the former Minister of Defence, indirectly alleging that the act was possibly committed through the Military Security Agency, the Security Services Control Committee demanded that the Inspector General of the Ministry of Defence Services, in line with its lawful duties, urgently inspect the legality of the implementation of special procedures and measures for the collection of confidential data by the Military Security Agency and as soon as possible submit its findings to the Security Services Control Committee.

The Committee members stated that in the current legislature the Security Services Control Committee had, in line with its lawful duties, realized 11 supervisory visits to the security services, four of them to the Military Security Agency. Of the four visits to the Military Security Agency, two were to the Military Security Agency Head Quarters in Belgrade, one to the Military Security Agency Centre in Novi Sad and one to the Military Security Agency Centre in Kraljevo. In the course of the supervisory visits to the Military Security Agency, the Committee members inspected the legality of the implementation of special procedures and measures outlined in the Law on the Military Security Agency and Military Intelligence Agency and the legality of the implementation of special evidentiary actions in accordance with the Criminal Procedure Code. Using random sample method, the Committee members gained direct insight into documentation on closed cases and ascertained that the Military Security Agency staff had acted professionally and in accordance with lawful procedure and that there had been no irregularities in the supervised cases.
