Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013

The Speaker of the National Assembly of the Republic of Serbia, MA Nebojsa Stefanovic, convened the Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013, for Wednesday, 8 May, starting at 11 am.


The National Assembly set the following agenda:

1. Railway Bill, submitted by the Government,
2. Bill on Patients’ Rights, submitted by the Government,
3. Bill on Protection of Persons with Mental Health Problems, submitted by the Government,
4. Bill on the Publication of Laws and Other Regulations and Acts, submitted by the Government,
5. Bill amending and modifying the Criminal Procedure Code, submitted by MPs Aleksandar Jugovic, Olgica Batic, Mirko Cikiriz, Zika Gojkovic and Aleksandar Cotric,
6. Bill on the Confirmation of the Strasbourg Convention on the Limitation of Liability in Inland Navigation (CLNI 2012), submitted by the Government,
7. Bill on the Confirmation of the Maritime Transport Cooperation Agreement between the Government of the Republic of Serbia and Government of the Republic of Cyprus, submitted by the Government,
8. Proposal of the Decision on the use and participation of the members of the Serbian Armed Forces in the European Union Training Mission Mali (EUTM Mali) in 2013, submitted by the Government,
9. Security Services Control Committee Report on the supervision implemented over the security services’ work in 2012, with a Decision Proposal on the adoption of said Report, submitted by the Security Services Control Committee of the National Assembly,
10. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Turkey on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, submitted by the Government,
11. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Macedonia on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, submitted by the Government,
12. Proposal of the Decision amending the Decision on the dismissal and appointment of members and substitute members of the Republic Electoral Commission, submitted by the Liberal Democratic Party Parliamentary Group,
13. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the United Regions of Serbia Parliamentary Group,
14. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Democratic Party Parliamentary Group.

By a majority of votes, the National Assembly decided to complete a joint debate in principle and single debate on items 1, 6 and 7 on the proposed agenda, a joint debate in principle on items 2 and 3 on the proposed agenda, a joint debate in principle on items 4 and 5 on the proposed agenda, a joint single debate on items 8 and 9 on the proposed agenda, a joint single debate on items 10 and 11 on the proposed agenda and a joint single debate on items 13 and 14 on the proposed agenda.

In the morning part of the proceedings, the National Assembly commenced the joint debate in principle and single debate on the Railway Bill, Bill on the Confirmation of the Strasbourg Convention on the Limitation of Liability in Inland Navigation (CLNI 2012 and the Bill on the Confirmation of the Maritime Transport Cooperation Agreement between the Government of the Republic of Serbia and Government of the Republic of Cyprus. The bills were explained, on the behalf of the submitter, by Minister of Transport Milutin Mrkonjic.

For the remainder of the day the National Assembly conducted the joint debate in principle and single debate on items 1, 6 and 7 on the agenda.

On the second day of the proceedings, 9 May, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Janko Veselinovic, Dejan Rajcic, Natasa Micic, Mirko Cikiriz, Milica Vojic Markovic and Nebojsa Stefanovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.
The National Assembly went on to conduct and conclude the joint debate in principle and single debate on items 1, 6 and 7 on the agenda.
After recess, the National Assembly conducted a joint debate in principle on items 2 and 3 on the agenda – the Bill on Patients’ Rights and the Bill on Protection of Persons with Mental Health Problems, which were explained to the MPs by Minister of Health Slavica Djukic Dejanovic.

On the third day of the proceedings, 10 May, the National Assembly continued the joint debate in principle on the Bill on Patients’ Rights and the Bill on Protection of Persons with Mental Health Problems.

By the end of the day, the National Assembly had completed the joint debate in principle on items 2 and 3 on the agenda.

On the fourth day of the session, 14 May, the National Assembly continued the proceedings with a joint debate in principle on the bills listed as items 4 and 5 on the agenda.
At the beginning of the proceedings, the heads i.e. authorised representatives of the parliamentary groups, MPs Olgica Batic, Dr Vladimir Marinkovic, Dr Slobodan Samardzic, Zoran Ostojic, Srdjan Milivojevic and Prof. Dr Marko Atlagic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.
The Bill amending and modifying the Criminal Procedure Code, submitted by MPs Aleksandar Jugovic, Olgica Batic, Mirko Cikiriz, Zika Gojkovic and Aleksandar Cotric, was elaborated by MP Mirko Cikiriz on the behalf of the submitters, while the Bill on the Publication of Laws and Other Regulations and Acts, was elaborated by Prof. Dr Dejan Djurdjevic, Director of the Republic Legislation Secretariat, on the behalf of the Government.
By the end of the day the National Assembly had concluded the joint debate in principle on the Bill on the Publication of Laws and Other Regulations and Acts and the Bill amending and modifying the Criminal Procedure Code.

On the fifth day of the proceedings, 15 May, the National Assembly commenced a joint single debate on items 8 and 9 on the agenda.
The Proposal of the Decision on the use and participation of the members of the Serbian Armed Forces in the European Union Training Mission Mali (EUTM Mali) in 2013 was elaborated by Minister of Foreign Affairs Ivan Mrkic, and the Security Services Control Committee Report on the supervision implemented over the security services’ work in 2012, with a Decision Proposal on the adoption of said Report, submitted by the Security Services Control Committee of the National Assembly, was elaborated by the Committee Chairperson, Jadranka Joksimovic.
By the end of the day, the National Assembly had concluded the joint single debate on items 8 and 9 on the agenda.
The National Assembly went on to also complete a joint single debate on items 10 and 11 on the agenda – the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Turkey on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Macedonia on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, which were also elaborated by Minister of Foreign Affairs Ivan Mrkic.

On the sixth day of the session, 16 May, the National Assembly continued the proceedings with a joint single debate on the decision proposals listed as items 12, 13 and 14 on the agenda.
At the beginning of the proceedings, the heads i.e. authorised representatives of the parliamentary groups, MPs Zika Gojkovic, Radoslav Komlenovic, Ivan Bauer, Miljenko Dereta, Slavica Saveljic, Milan Lapcevic, Sasa Dujovic, Dr Janko Veselinovic and Miodrag Linta, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.
Before recess, the National Assembly concluded the joint single debate on the Proposal of the Decision amending the Decision on the dismissal and appointment of members and substitute members of the Republic Electoral Commission, submitted by the Liberal Democratic Party Parliamentary Group, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the United Regions of Serbia Parliamentary Group, and the Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Democratic Party Parliamentary Group.
The National Assembly went on to discuss the Railway Bill in detail.
By the end of the day the National Assembly had concluded the debate in detail on the Railway Bill.

On the seventh day of the session, 20 May, the National Assembly continued the proceedings with a debate in detail on the Bill on Patients’ Rights.
In the morning part of the proceedings, the National Assembly Speaker, MA Nebojsa Stefanovic, greeted, on the behalf of the MPs and himself, the students of the Nis Faculty of Law who viewed part of the sitting from the gallery of the Grand Hall.
By the end of the day the National Assembly had concluded the debate in detail on the Bill on Patients’ Rights. The National Assembly also completed a debate in detail on the Bill on Protection of Persons with Mental Health Problems.

On the eighth day of the session, 21 May, the National Assembly continued the proceedings with a debate in detail on the Bill on the Publication of Laws and Other Regulations and Acts and the Bill amending and modifying the Criminal Procedure Code.
At the beginning of the proceedings, the heads i.e. authorised representatives of the parliamentary groups, MPs Milos Aligrudic, Aleksandar Jugovic, Bojan Djuric, Janko Veselinovic, Sasa Dujovic, Dubravka Filipovski and Milovan Drecun, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.
By the end of the day, the National Assembly had concluded the debate in detail on the Bill on the Publication of Laws and Other Regulations and Acts and the Bill amending and modifying the Criminal Procedure Code.
As the National Assembly had completed the debate on all the items on the agenda for the sitting, the Chair, National Assembly Deputy Speaker Vesna Kovac, set Wednesday, 22 May, as Voting Day on all the items on the agenda for the Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013, starting at 10 am.

Voting Day

On Voting Day, 22 May, by a majority of votes, the National Assembly adopted the Railway Bill, Bill on Patients’ Rights, Bill on Protection of Persons with Mental Health Problems, Bill on the Publication of Laws and Other Regulations and Acts and the Bill amending and modifying the Criminal Procedure Code.

By a majority of votes, the MPs adopted the Bill on the Confirmation of the Strasbourg Convention on the Limitation of Liability in Inland Navigation (CLNI 2012), Bill on the Confirmation of the Maritime Transport Cooperation Agreement between the Government of the Republic of Serbia and Government of the Republic of Cyprus, Proposal of the Decision on the use and participation of the members of the Serbian Armed Forces in the European Union Training Mission Mali (EUTM Mali) in 2013, and the Proposal of the Decision on the adoption of the Security Services Control Committee Report on the supervision implemented over the security services’ work in 2012.

By a majority of votes, the National Assembly also adopted the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Turkey on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Macedonia on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices.

By a majority of votes, the MPs also adopted the Proposal of the Decision amending the Decision on the dismissal and appointment of members and substitute members of the Republic Electoral Commission, submitted by the Liberal Democratic Party Parliamentary Group, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the United Regions of Serbia Parliamentary Group, and the Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Democratic Party Parliamentary Group.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the Third Sitting of the First Regular Session and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, the National Assembly Speaker, MA Nebojsa Stefanovic, concluded the Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013.
