Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013

The National Assembly Speaker, MA Nebojsa Stefanovic, convened the Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013, for Tuesday, 26 March 2013, starting at 11 am.


At the beginning of the proceedings, the heads i.e. authorised representatives of the parliamentary groups, MPs Mirko Cikiriz, Zaharije Trnavcevic, Nebojsa Zelenovic, Slavica Saveljic, Miljenko Dereta, Dubravka Filipovski, Branko Gogic, Slobodan Samardzic, Srdjan Milivojevic and Dragomir Karic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly set the following agenda:

1. Proposal of the Decision on the Election of President and Members of the Republic Commission for the Protection of Rights in Public Procurement Procedures, submitted by the Committee on Finance, State Budget and Control of Public Spending,
2. Bill on Special Measures for the Prevention of Crimes against Sexual Freedom against Minors, submitted by the Government,
3. Bill on Seizure and Confiscation of Proceeds from Crime, submitted by the Government,
4. Bill amending the Law on Organisation and Jurisdiction of Government Authorities in Suppression of Organised Crime, Corruption and other Severe Criminal Offenses, submitted by the Government,
5. Bill amending and modifying the Criminal Procedure Code, submitted by the Government,
6. Bill amending and modifying the Labour Law, submitted by Member of Parliament MA Nebojsa Stefanovic,
7. Bill amending and modifying the Law on Professional Rehabilitation and Employment of Persons with Disabilities, submitted by the Government,
8. Bill on Conclusion and Implementation of International Treaties, submitted by the Government,
9. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Slovenia on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, submitted by the Government,
10. Bill on the Confirmation of the Agreement between the Republic of Serbia and the State of Israel on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, submitted by the Government,
11. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Bulgaria on Mutual Protection and Exchange of Confidential Information, submitted by the Government,
12. Bill on the Confirmation of the Police Cooperation Agreement between the Government of the Republic of Serbia and Government of the Republic of Slovenia, submitted by the Government,
13. Nominations of Candidates for the Election of Members of the Anti-Corruption Agency Board, submitted by the authorised submitters:
- Committee on Administrative, Budgetary, Mandate and Immunity Issues of the National Assembly,
- Supreme Court of Cassation,
- State Audit Institution,
- jointly the Ombudsman and Commissioner for Information of Public Importance and Personal Data Protection and
- Serbian Bar Association,
14. Proposal of the Decision on the Election of Deputy Commissioner for Information of Public Importance and Personal Data Protection, submitted by the Commissioner for Information of Public Importance and Personal Data Protection,
15. Proposal of the Decision on the Establishment of a Board of Inquiry to Ascertain the Facts on the Manner of Expenditure of Republic of Serbia Budgetary Funds on the Territory of the Autonomous Province of Kosovo-Metohija in the period 2000-2012, submitted by MP Milovan Drecun and
16. Proposal of the Decision on the Termination of Office of Public Prosecutor at the Higher Public Prosecutor’s Office in Novi Sad, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government of the National Assembly.

By a majority of votes, the National Assembly accepted the proposal of MP Zoran Babic to complete a joint debate in principle and single debate on items 2, 3, 4, 5 and 11 on the agenda, a joint debate in principle and single debate on items 8, 9, 10 and 12 on the agenda, as well as a joint single debate on items 13, 14, 15 and 16 on the agenda for the sitting.

The National Assembly went on to conduct and conclude a single debate on the Proposal of the Decision on the Election of President and Members of the Republic Commission for the Protection of Rights in Public Procurement Procedures. The Chair, National Assembly Deputy Speaker Vesna Kovac, reminded of the provision of article 87, paragraph 5, of the National Assembly Rules of Procedure according to which the National Assembly Speaker can set a Voting Day on a bill immediately after the conclusion of the debate on said bill.

In accordance with the provision, National Assembly Deputy Speaker Vesna Kovac set Tuesday, 26 March 2013, 3 pm, as Voting Day on the first item on the agenda for the sitting i.e. the Proposal of the Decision on the Election of President and Members of the Republic Commission for the Protection of Rights in Public Procurement Procedures.

Voting Day

On Voting Day, 26 March 2013, by a majority of votes, the National Assembly adopted the Proposal of the Decision on the Election of President and Members of the Republic Commission for the Protection of Rights in Public Procurement Procedures.

For the remainder of the day the National Assembly conducted a joint debate in principle and single debate on items 2, 3, 4, 5 and 11 on the agenda i.e. the Bill on Special Measures for the Prevention of Crimes against Sexual Freedom against Minors, Bill on Seizure and Confiscation of Proceeds from Crime, Bill amending the Law on Organisation and Jurisdiction of Government Authorities in Suppression of Organised Crime, Corruption and other Severe Criminal Offenses, Bill amending and modifying the Criminal Procedure Code, and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Bulgaria on Mutual Protection and Exchange of Confidential Information.

The bills were elaborated by Minister of Justice and Public Administration Nikola Selakovic.

On the second day of the proceedings, 27 March, the National Assembly continued and concluded the joint debate in principle and single debate on items 2, 3, 4, 5 and 11 on the agenda for the sitting.
The National Assembly went on to commence and conduct a debate in principle on the Bill amending and modifying the Labour Law, submitted by Member of Parliament MA Nebojsa Stefanovic.

On the third day of the proceedings, 28 March, the National Assembly continued the debate in principle on the Bill amending and modifying the Labour Law.

Before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Neven Cveticanin, Zoran Ostojic, Konstantin Arsenovic, Miodrag Djidic, Mirko Cikiriz, Nikola Jovanovic, Milan Lapcevic, Janko Veselinovic and Ljubica Mrdakovic Todorovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The Chair, National Assembly Deputy Speaker Vesna Kovac, greeted the students of the Faculty of Engineering Management who were following part of the National Assembly sitting from the gallery of the Grand Hall, on the behalf of the MPs and herself.

In the course of the sitting, the Chair, National Assembly Deputy Speaker Konstantin Arsenovic, greeted, on the behalf of the MPs and himself, the 65 young people from Bujanovac, Presevo and Vranje who followed part of the National Assembly sitting from the gallery of the Grand Hall.

For the remainder of the day the MPs conducted the debate in principle on the Bill amending and modifying the Labour Law.

On the fourth day the proceedings, before moving onto the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Elvira Kovacs, Bojan Djuric, Predrag Markovic, Miroslav Markicevic, Slobodan Samardzic, Olena Papuga, Vesna Stepic, Borislav Stefanovic and Momir Stojanovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

Before recess, the National Assembly continued and completed the debate in principle on the Bill amending and modifying the Labour Law.

After recess, the National Assembly commenced a debate in principle on the Bill amending and modifying the Law on Professional Rehabilitation and Employment of Persons with Disabilities, elaborated by Deputy Prime Minister and Minister of Labour, Employment and Social Policy Jovan Krkobabic.

At the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the termination of the terms of office of MPs Jovanka Petrovic and Mica Rogovic, before the expiry of the term they were elected for.

By the end of the day, the National Assembly had completed the debate in principle on the seventh item on the agenda – the Bill amending and modifying the Law on Professional Rehabilitation and Employment of Persons with Disabilities

On the fifth day, 3 April, the National Assembly continued the proceedings with a joint debate in principle and single debate on the bills listed as items 8, 9, 10 and 12 on the agenda. The bills were justified, on the behalf of the submitter, by Minister of Justice and Public Administration Nikola Selakovic.

In the afternoon part of the sitting the National Assembly concluded the debate on the Bill on Conclusion and Implementation of International Treaties, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Slovenia on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, Bill on the Confirmation of the Agreement between the Republic of Serbia and the State of Israel on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, and the Bill on the Confirmation of the Police Cooperation Agreement between the Government of the Republic of Serbia and Government of the Republic of Slovenia.

By the end of the day, the National Assembly had also completed a joint single debate on items 13, 14, 15 and 16 on the agenda.

On the sixth day, 4 April, the National Assembly continued the proceedings with a debate in detail on the Bill on Special Measures for the Prevention of Crimes against Sexual Freedom against Minors.

Before moving onto the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Kenan Hajdarevic, Milica Vojic Markovic, Dusan Milisavljevic, Dragan Todorovic, Djordje Stojsic, Mirko Cikiriz and Zlata Djeric, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

In the course of the day, the National Assembly completed the debate in detail on the Bill on Special Measures for the Prevention of Crimes against Sexual Freedom against Minors, as well as on the Bill on Seizure and Confiscation of Proceeds from Crime, Bill amending the Law on Organisation and Jurisdiction of Government Authorities in Suppression of Organised Crime, Corruption and other Severe Criminal Offenses, Bill amending and modifying the Criminal Procedure Code, and the Bill amending and modifying the Labour Law.

On the seventh day of the proceedings, 5 April, the National Assembly completed a debate in detail on the Bill amending and modifying the Law on Professional Rehabilitation and Employment of Persons with Disabilities and the Bill on Conclusion and Implementation of International Treaties.

On the eighth day, 8 April, before moving onto the agenda, National Assembly Deputy Speaker Vesna Kovac congratulated all the members of the Roma ethnic community on the International Roma Day.

By a majority of votes, the National Assembly included the Nomination for the Election of a Member of the Anti-Corruption Agency Board, submitted by the Social Economic Council of the Republic of Serbia, into the agenda for the Second Sitting of the First Regular Session of the National Assembly in 2013.

As the National Assembly had concluded the debate on all the items on the agenda for the sitting and voted on the first item on the agenda, the Proposal of the Decision on the Election of President and Members of the Republic Commission for the Protection of Rights in Public Procurement Procedures, the Chair, National Assembly Deputy Speaker Vesna Kovac set Monday, 8 April, as Voting Day on the remaining items on the agenda for the Second Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013, starting at 10.20 am.

Voting Day

On Voting Day, 8 April, by a majority of votes, the National Assembly adopted the Bill on Special Measures for the Prevention of Crimes against Sexual Freedom against Minors, Bill on Seizure and Confiscation of Proceeds from Crime, Bill amending the Law on Organisation and Jurisdiction of Government Authorities in Suppression of Organised Crime, Corruption and other Severe Criminal Offenses and the Bill amending and modifying the Criminal Procedure Code.

By a majority of votes, the MPs also adopted the Bill amending and modifying the Labour Law and the Bill amending and modifying the Law on Professional Rehabilitation and Employment of Persons with Disabilities.

By a majority of votes, the National Assembly also adopted the Bill on Conclusion and Implementation of International Treaties, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Slovenia on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, Bill on the Confirmation of the Agreement between the Republic of Serbia and the State of Israel on the Employment of Family Members of the Staff of Diplomatic and Consular Representative Offices, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and Government of the Republic of Bulgaria on Mutual Protection and Exchange of Confidential Information and the Bill on the Confirmation of the Police Cooperation Agreement between the Government of the Republic of Serbia and Government of the Republic of Slovenia.

By a majority of MPs’ votes, the National Assembly elected Prof. Dr Zoran Stojiljkovic, professor of the Faculty of Political Sciences in Belgrade, Nikola Stanojevic, retired judge of the Serbian Supreme Court, Prof. Dr Evica Petrovic, prorector of the University of Nis, Dr Branko Lubarda, professor of the Faculty of Law in Belgrade and Zoran Vujicic, lawyer, members of the Anti-Corruption Agency Board.

By a majority of votes, the MPs adopted the Proposal of the Decision on the Election of Deputy Commissioner for Information of Public Importance and Personal Data Protection, Proposal of the Decision on the Establishment of a Board of Inquiry to Ascertain the Facts on the Manner of Expenditure of Republic of Serbia Budgetary Funds on the Territory of the Autonomous Province of Kosovo-Metohija in the period 2000-2012 and the Proposal of the Decision on the Termination of Office of Public Prosecutor at the Higher Public Prosecutor’s Office in Novi Sad.

By a majority of votes, the National Assembly elected Dr Bozo Draskovic member of the Anti-Corruption Agency Board.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the Second Sitting of the First Regular Session and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, the Chair, National Assembly Deputy Speaker Vesna Kovac, concluded the Seconds Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2013.
