Ninth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2012

The Speaker of the National Assembly of the Republic of Serbia, MA Nebojsa Stefanovic, convened the Ninth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2012, for Saturday, 15 December 2012, starting at 10 am. The sitting started at 12.25 pm.


The National Assembly set the following agenda:

1. Bill amending and modifying the Criminal Code, submitted by the Government;
2. Bill amending the Criminal Procedure Code, submitted by the Government;
3. Bill amending the Law on Public Prosecution, submitted by the Government;
4. Bill amending the Law on Judges, submitted by the Government;
5. Bill amending the Law on Stimulating the Construction Industry of the Republic of Serbia in response to the new Conditions of the Economic Crisis, submitted by the Government;
6. Bill Granting Guarantee by the Republic of Serbia in favour of German Development Bank KfW, Frankfurt-am-Main, to settle the debt of Electric Power Industry of Serbia Public Enterprise, Belgrade (Project: "Improvement of the exploitation technology at Kolubara Mining Basin aimed at boosting the efficiency of thermal power plants and decreasing the environmental impact”), submitted by the Government;
7. Bill amending and modifying the Law on Navigation and Ports on Inland Waterways, submitted by the Government;
8. Proposal of the Decision on the Adoption of the Annual Plan for the use of the Serbian Armed Forces and other defence forces in multinational operations in 2012, submitted by the Government;
9. Proposal of the Decision on the participation of Serbian Army personnel in multinational operations in 2012, submitted by the Government;
10. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Russian Federation on the Foundation of the Serbian-Russian Humanitarian Centre, submitted by the Government;
11. Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Greece, submitted by the Government;
12. Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Federal Republic of Brazil, submitted by the Government;
13. Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the Government of the Republic of Indonesia on Cooperation in the field of Defence, submitted by the Government;
14. Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Angola, submitted by the Government;
15. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Slovak Republic on Reciprocal Protection of Classified Information, submitted by the Government;
16. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Belarus on Mutual Assistance in Customs Matters, submitted by the Government;
17. Bill on the Confirmation of the Agreement between the Republic of Serbia and Georgia on Avoidance of Double Taxation with respect to Taxes on Income and Property, submitted by the Government;
18. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Tunisia on Avoidance of Double Taxation with respect to Taxes on Income and Property, submitted by the Government;
19. Bill on the Confirmation of the Agreement between the Republic of Serbia and Canada on Avoidance of Double Taxation with respect to Taxes on Income and Property, submitted by the Government;
20. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Council of Ministers of Bosnia and Herzegovina on Navigation on Internal Waterways and their Technical Maintenance, submitted by the Government;
21. Proposal of the Decision amending the Decision on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by the National Assembly Speaker;
22. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia Parliamentary Group;
23. Bill amending the Law on Planning and Construction, submitted by the Government;
24. Proposal of the Decision granting consent to the Decision amending and modifying the Republic Health Insurance Fund 2012 Financial Plan, submitted by the Government.

By a majority of votes, the National Assembly accepted the proposal of MP Vladimir Ilic to complete a joint debate in principle on items 1, 2, 3 and 4 on the agenda, joint debate in principle and single debate on items 5, 7, 20 and 23 on the agenda, joint debate in principle and single debate on items 6, 16, 17, 18, 19 and 24 on the agenda, joint single debate items 8, 9, 10, 11, 12, 13, 14 and 15 on the agenda for the sitting and a joint single debate items 21 and 22 on the agenda.

The National Assembly proceeded to conduct and conclude a joint debate in principle on the Bill amending and modifying the Criminal Code, Bill amending the Criminal Procedure Code, Bill amending the Law on Public Prosecution and the Bill amending the Law on Judges. The bills were elaborated by Minister of Justice and Public Administration Nikola Selakovic.

On the second day of work, 17 December, the National Assembly conducted and concluded a joint debate in principle and single debate on the bills listed as items 5, 7, 20 and 23 on the agenda for the sitting: the Bill amending the Law on Stimulating the Construction Industry of the Republic of Serbia in response to the new Conditions of the Economic Crisis, Bill amending and modifying the Law on Navigation and Ports on Inland Waterways, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Council of Ministers of Bosnia and Herzegovina on Navigation on Internal Waterways and their Technical Maintenance and the Bill amending and modifying the Law on Planning and Construction. The bills were explained to the MPs by the Minister of Construction and Urbanism, Velimir Ilic.

On the third day of work, 18 December, the National Assembly continued the proceedings with a joint debate in principle and single debate on items 6, 16, 17, 18, 19 and 24 on the agenda for the sitting, which were elaborated by the representative of the submitter, Verica Kalanovic, Minister of Regional Development and Local Self-Government.

Before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Aleksandra Jerkov, Mirko Cikiriz, Milorad Mijatovic, Zoran Ostojic, Aleksandar Pejcic and Veroljub Arsic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

By the end of the day, the National Assembly had completed the joint debate in principle and single debate on the Bill Granting Guarantee by the Republic of Serbia in favour of German Development Bank KfW, Frankfurt-am-Main, to settle the debt of Electric Power Industry of Serbia Public Enterprise, Belgrade (Project: "Improvement of the exploitation technology at Kolubara Mining Basin aimed at boosting the efficiency of thermal power plants and decreasing the environmental impact”); Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Belarus on Mutual Assistance in Customs Matters; Bill on the Confirmation of the Agreement between the Republic of Serbia and Georgia on Avoidance of Double Taxation with respect to Taxes on Income and Property; Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Tunisia on Avoidance of Double Taxation with respect to Taxes on Income and Property; Bill on the Confirmation of the Agreement between the Republic of Serbia and Canada on Avoidance of Double Taxation with respect to Taxes on Income and Property and the Proposal of the Decision granting consent to the Decision amending and modifying the Republic Health Insurance Fund 2012 Financial Plan.

On the fourth day of work, 20 December, the National Assembly conducted and concluded a joint single debate on items 8, 9, 10, 11, 12, 13, 14 and 15 on the agenda. The bills and decision proposals were elaborated by the First Deputy Prime Minister responsible for defence, security and the fight against corruption and crime and Minister of Defence, Aleksandar Vucic.

Before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Dr Neven Cveticanin, Olena Papuga, Mirko Cikiriz, Judita Popovic, Dr Slobodan Samardzic and Prof. Dr Marko Atlagic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly went on to complete a joint single debate on the Proposal of the Decision amending the Decision on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by the National Assembly Speaker and the Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Socialist Party of Serbia Parliamentary Group.

By the end of the day, the National Assembly had conducted and completed a debate in detail on the Bill amending and modifying the Criminal Code and the Bill amending the Criminal Procedure Code.

On the fifth day of work, 21 December, the National Assembly conducted and concluded a debate in detail on the Law on Stimulating the Construction Industry of the Republic of Serbia in response to the new Conditions of the Economic Crisis.

The National Assembly went on to debate in detail the Bill Granting Guarantee by the Republic of Serbia in favour of German Development Bank KfW, Frankfurt-am-Main, to settle the debt of Electric Power Industry of Serbia Public Enterprise, Belgrade (Project: "Improvement of the exploitation technology at Kolubara Mining Basin aimed at boosting the efficiency of thermal power plants and decreasing the environmental impact”), submitted by the Government. Since no amendments have been submitted to the Bill, on Voting Day, the National Assembly will vote on the Bill in its entirety.

In the continuation, the National Assembly completed a debate in detail on the Bill amending and modifying the Law on Navigation and Ports on Inland Waterways and the Bill amanding the Law on Planning and Construction.

As the National Assembly had concluded the debate on all the items on the agenda for the Ninth Sitting of the Second Regular Session, National Assembly Deputy Speaker Konstantin Arsenovic set Monday, 24 December 2012, as Voting Day on all the items on the agenda for the Ninth Sitting of the Second Regular Session of the National Assembly in 2012, starting at 10 am.

Voting Day

On Voting Day, 24 December, the National Assembly adopted the Bill amending and modifying the Criminal Code, Bill amending the Criminal Procedure Code, Bill amending the Law on Public Prosecution and the Bill amending the Law on Judges, by a majority of votes.

By a majority of votes, the National Assembly also adopted the Bill amending the Law on Stimulating the Construction Industry of the Republic of Serbia in response to the new Conditions of the Economic Crisis, Bill Granting Guarantee by the Republic of Serbia in favour of German Development Bank KfW, Frankfurt-am-Main, to settle the debt of Electric Power Industry of Serbia Public Enterprise, Belgrade (Project: "Improvement of the exploitation technology at Kolubara Mining Basin aimed at boosting the efficiency of thermal power plants and decreasing the environmental impact”), Bill amending and modifying the Law on Navigation and Ports on Inland Waterways, as well as the Proposal of the Decision on the Adoption of the Annual Plan for the use of the Serbian Armed Forces and other defence forces in multinational operations in 2012 and the Proposal of the Decision on the participation of Serbian Army personnel in multinational operations in 2012.

By a majority of votes, the MPs adopted the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Russian Federation on the Foundation of the Serbian-Russian Humanitarian Centre, Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Greece, Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Federal Republic of Brazil, Bill on the Confirmation of the Memorandum of Understanding between the Government of the Republic of Serbia and the Government of the Republic of Indonesia on Cooperation in the field of Defence, Bill on the Confirmation of the Defence Cooperation Agreement between the Government of the Republic of Serbia and the Government of the Republic of Angola, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Slovak Republic on Reciprocal Protection of Classified Information, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Belarus on Mutual Assistance in Customs Matters, Bill on the Confirmation of the Agreement between the Republic of Serbia and Georgia on Avoidance of Double Taxation with respect to Taxes on Income and Property, Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Tunisia on Avoidance of Double Taxation with respect to Taxes on Income and Property, Bill on the Confirmation of the Agreement between the Republic of Serbia and Canada on Avoidance of Double Taxation with respect to Taxes on Income and Property and the Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Council of Ministers of Bosnia and Herzegovina on Navigation on Internal Waterways and their Technical Maintenance.

By a majority of MPs’ votes, the National Assembly also adopted the Proposal of the Decision amending the Decision on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, Bill amending the Law on Planning and Construction and the Proposal of the Decision granting consent to the Decision amending and modifying the Republic Health Insurance Fund 2012 Financial Plan.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the Ninth Sitting of the Second Regular Session and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, the National Assembly Speaker, MA Nebojsa Stefanovic, concluded the Ninth Sitting of the Second Regular Session of the National Assembly in 2012.
