Ninth Sitting of the Committee on Spatial Planning, Transport, Infrastructure and Telecommunications

At the sitting held on 7 March, the members of the Committee on Spatial Planning, Transport, Infrastructure and Telecommunications discussed, in principle, the Bill on Special Conditions for Registry of Ownership Rights for Buildings Constructed without a Construction Permit, submitted by the Government.


Assistant Minister of Construction and Urbanism Aleksandra Damnjanovic said that the Bill regulated the property records of facilities or parts of facilities built without construction permit, not their legalisation which would be regulated by another law.
In the course of a long debate, the Committee members, MPs and representatives of the Anti-Corruption Agency and the Standing Conference of Towns and Municipalities shared opposing views on the Bill. The Committee members and MPs asked whether the effects of the Bill and how its enforcement would affect the restitution and legalisation process were analysed. Some Committee members asked about the Bill’s adherence to the Constitution of the Republic of Serbia. Some of the participants of the debate also opined that the Bill resolves the problems of a great many Serbian citizens.
Assistant Director of the Anti-Corruption Agency Marijana Obradovic said that the Agency drafted an Opinion on the Bill, within its purview, which pointed out the corruption risks and recommended ways to eliminate them.
The President of the Standing Conference of Towns and Municipalities, Sasa Paunovic, pointed out that some of the provisions of the Bill are unfavourable for local self-governments and briefed the Committee members on the amendments proposed by the Standing Conference of Towns and Municipalities to the Bill, which have been submitted to the Committee.
Following the debate the Committee adopted the Bill on Special Conditions for Registry of Ownership Rights for Buildings Constructed without a Construction Permit, in principle.
The Committee members went on to adopt the Ministry of Construction and Urbanism Activity Report covering the period from 27 October 2012 to 27 January 2013, elaborated by Assistant Minister of Construction and Urbanism Aleksandra Damnjanovic, as well as the Ministry of Natural Resources, Mining and Spatial Planning Activity Report for the period November – December 2012 and January 2013, elaborated by Advisor to the Minister of Natural Resources, Mining and Spatial Planning Milan Punisic.
This sitting was chaired by Dejan Radenkovic, Committee Chairman.
