Fifth Extraordinary Session of the National Assembly of the Republic of Serbia, 13th Legislature

At the request of 104 MPs, the Speaker of the National Assembly of the Republic of Serbia Dr Vladimir Orlic convened the Fifth Extraordinary Session of the National Assembly of the Republic of Serbia, 13th Legislature for Tuesday, 5 September 2023, starting at 10 am.


Before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs MA Akos Ujhelyi, Radomir Lazovic, Milija Miletic, MA Ivan Kostic, Miroslav Aleksic, Stefan Krkobabic, Nebojsa Zelenovic, Dragana Miljanic, Sanda Raskovic Ivic, Srdjan Milivojevic, Miloratka Bojovic, Marinika Tepic, Radovan Arezina and Jelena Milivojevic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The following agenda was set in the request:

  1. Bill amending and modifying the Republic of Serbia 2023 Budget Law, with its accompanying Proposal of the Decision to grant consent to the Republic Pension and Disability Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Republic Health Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Fund for Social Insurance of Military Insured 2023 Financial Plan and the Proposal of the Decision to grant consent to the National Employment Service 2023 Financial Plan, submitted by the Government;
  2. Bill amending and modifying the Excise Tax Law, submitted by the Government;
  3. Proposal to Elect Slobodan Cvetkovic Minister of Justice in the Government of the Republic of Serbia, submitted by the Prime Minister;
  4. Bill amending and modifying the Law on Pension and Disability Insurance, submitted by the Government;
  5. Bill on the Management of Companies Owned by the Republic of Serbia, submitted by the Government;
  6. Bill amending and modifying the Law on Road Traffic Safety, submitted by the Government;
  7. Bill amending and modifying the Law on Dual Education, submitted by the Government;
  8. Bill amending the Law on Educational Inspection, submitted by the Government;
  9. Bill amending and modifying the Law on National Qualifications Framework of the Republic of Serbia, submitted by the Government;
  10. Bill amending and modifying the Law on Higher Education, submitted by the Government;
  11. Bill on the Engagement of Civilians in International Missions and Operations outside of the Republic of Serbia Borders, submitted by the Government;
  12. Bill amending and modifying the Law on Culture, submitted by the Government;
  13. Bill on Film and Other Audiovisual Heritage, submitted by the Government;
  14. Bill on the Confirmation of the Agreement between the Republic of Serbia, of the one part, and the European Union, of the other part, on the participation of the Republic of Serbia in the Union’s Civil Protection Mechanism, submitted by the Government;
  15. Bill on the Confirmation of the Loan Agreement between KfW, Frankfurt am Main and the Republic of Serbia represented by the and through the Ministry of Finance for Policy Based Loan (PBL) – Reform of the Energy and Environmental Sectors of Serbia, submitted by the Government;
  16. Bill on the Confirmation of the Film Co-Production Agreement between the Government of the Republic of Serbia and the Government of the Republic of Italy, submitted by the Government;
  17. Bill on the Confirmation of the amendment to the Agreement between the Government of the Republic of Serbia and the Government of the Republic of France on Social Security, submitted by the Government;
  18. Bill on the Confirmation of the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights (OP-ICESCR), submitted by the Government;
  19. Bill on Confirmation of the amendments and modifications to the Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be used for such Carriage (ATP), submitted by the Government;
  20. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Italy on Reciprocal Recognition and Exchange of Driving Licences, submitted by the Government;
  21. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Azerbaijan on Mutual Visa Abolition for Holders of Ordinary Passports, submitted by the Government;
  22. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Equatorial Guinea on Visa Abolition for Diplomatic and Service Passport Holders, submitted by the Government;
  23. Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Gabon on Visa Abolition for Diplomatic and Service Passport Holders, submitted by the Government;
  24. Bill on the Confirmation of the Protocol of 1988 relating to the International Convention for the Safety of Life at Sea, 1974, submitted by the Government, and
  25. Bill on the Confirmation of the Memorandum of Understanding between the European Union, on the one part, and the Republic of Serbia, on the other part, on the participation of the Republic of Serbia in the Employment and Social Innovation (EaSI) Strand of the European Social Fund Plus (ESF+), submitted by the Government.
The National Assembly accepted the proposal of National Assembly Speaker Dr Vladimir Orlic to complete a joint debate in principle and single debate on all the items on the agenda.

The bills were presented by Prime Minister Ana Brnabic.

As the National Assembly completed the joint debate in principle and single debate on items 1-25 on the agenda, National Assembly Speaker Dr Vladimir Orlic reminded the attending of Article 157, item 4 of the National Assembly Rules of Procedure according to which the completed debate in principle on the Republic of Serbia Budget Bill is immediately followed by a debate on the particulars.

The National Assembly Speaker set Wednesday, 6 September 2023, as Voting Day on item 3 on the agenda, starting at 11.30 am

The National Assembly then commenced and concluded a debate on the particulars on item 1 on the agenda - Bill amending and modifying the Republic of Serbia 2023 Budget Law, with its accompanying Proposal of the Decision to grant consent to the Republic Pension and Disability Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Republic Health Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Fund for Social Insurance of Military Insured 2023 Financial Plan and the Proposal of the Decision to grant consent to the National Employment Service 2023 Financial Plan.

Voting Day

On the second day of the proceedings, 6 September 2023, on Voting Day on item 3 on the agenda of the Fifth Extraordinary Session of the National Assembly of the Republic of Serbia, 13th Legislature, by roll call, the MPs elected Slobodan Cvetkovic Minister of Justice in the Government of the Republic of Serbia by 148 votes in favour.

Following the vote, the newly-elected Minister took the oath of office before the National Assembly and National Assembly Speaker Dr Vladimir Orlic wished him success in all his efforts.

The National Assembly then completed a debate in detail on the Bill amending and modifying the Excise Tax Law, Bill amending and modifying the Law on Pension and Disability Insurance, Bill on the Management of Companies Owned by the Republic of Serbia, Bill amending and modifying the Law on Road Traffic Safety, Bill amending and modifying the Law on Dual Education, Bill amending and modifying the Law on National Qualifications Framework of the Republic of Serbia, Bill amending and modifying the Law on Higher Education, Bill on the Engagement of Civilians in International Missions and Operations outside of the Republic of Serbia Borders and the Bill amending and modifying the Law on Culture and the Bill on the Confirmation of the Loan Agreement between KfW, Frankfurt am Main and the Republic of Serbia represented by the and through the Ministry of Finance for Policy Based Loan (PBL) – Reform of the Energy and Environmental Sectors of Serbia.

As the National Assembly had completed the debate in principle and in detail on all the items on the agenda, National Assembly Speaker Dr Vladimir Orlic set Wednesday, 6 September 2023, as Voting Day on items 1, 2 and 4 to 25 on the agenda of the Fifth Extraordinary Session of the National Assembly of the Republic of Serbia, 13th Legislature, starting at 2.05 pm.

Voting Day

On Voting Day, 6 September 2023, the National Assembly adopted, by 140 votes in favour, the Bill amending and modifying the Republic of Serbia 2023 Budget Law, with its accompanying Proposal of the Decision to grant consent to the Republic Pension and Disability Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Republic Health Insurance Fund 2023 Financial Plan, Proposal of the Decision to grant consent to the Fund for Social Insurance of Military Insured 2023 Financial Plan and the Proposal of the Decision to grant consent to the National Employment Service 2023 Financial Plan, submitted by the Government.

By majority vote, the National Assembly also adopted the Bill amending and modifying the Excise Tax Law, Bill amending and modifying the Law on Pension and Disability Insurance, Bill on the Management of Companies Owned by the Republic of Serbia, Bill amending and modifying the Law on Road Traffic Safety, Bill amending and modifying the Law on Dual Education, Bill amending the Law on Educational Inspection, Bill amending and modifying the Law on National Qualifications Framework of the Republic of Serbia, Bill amending and modifying the Law on Higher Education, Bill on the Engagement of Civilians in International Missions and Operations outside of the Republic of Serbia Borders, Bill amending and modifying the Law on Culture, Bill on Film and Other Audiovisual Heritage, Bill on the Confirmation of the Agreement between the Republic of Serbia, of the one part, and the European Union, of the other part, on the participation of the Republic of Serbia in the Union’s Civil Protection Mechanism and the Bill on the Confirmation of the Loan Agreement between KfW, Frankfurt am Main and the Republic of Serbia represented by the and through the Ministry of Finance for Policy Based Loan (PBL) – Reform of the Energy and Environmental Sectors of Serbia.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Dr Vladimir Orlic concluded the Fifth Extraordinary Session of the National Assembly of the Republic of Serbia, 13th Legislature.
