Eighth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2012

The Speaker of the National Assembly of the Republic of Serbia, MA Nebojsa Stefanovic, convened the Eighth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2012, for Thursday, 22 November 2012, starting at 11 am.


Before the beginning of the sitting, the heads i.e. authorised representatives of the parliamentary groups, MPs Elvira Kovacs, Olgica Batic, Djordje Stojsic, Slavica Savic, Zoran Ostojic, Petar Petkovic, Miroslav Markicevic, Gorica Mojovic and Miodrag Linta requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly set the following agenda:

1. Bill amending the Budget System Law, submitted by the Assembly of the Autonomous Province of Vojvodina,
2. Republic of Serbia 2013 Budget Bill, with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2013 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2013 Financial Plan, submitted by the Government,
3. Bill amending and modifying the Corporate Income Tax Law, submitted by the Government,
4. Bill amending and modifying the Excise Tax Law, submitted by the Government,
5. Bill on Payment Deadlines in Commercial Transactions, submitted by the Government,
6. Bill on Conditional Write-off of Interest and Tax Debt Dormancy, submitted by the Government,
7. Bill amending and modifying the Law on Foreign Currency Transactions, submitted by the Government,
8. Bill on Public Enterprises, submitted by the Government,
9. Bill amending and modifying the Republic of Serbia Development Fund Law, submitted by the Government,
10. Bill amending and modifying the Privatisation Law, submitted by the Government,
11. Bill on Default Interest, submitted by the Government,
12. Bill amending the Insurance Law, submitted by the Government,
13. Bill amending and modifying the Law on Copyright and Related Rights, submitted by the Government,
14. Bill on the Assumption of Obligations of Health Care Institutions toward Wholesale Pharmacies arising from Procurement of Medicines and Medical Material and Transforming Said Obligations into the Public Debt of the Republic of Serbia, submitted by the Government,
15. Bill amending and modifying the Health Care Law, submitted by the Government,
16. Bill amending and modifying the Health Insurance Law, submitted by the Government,
17. Proposal of the Decision on the Election of Members of the Commission for the Control of the Execution of Criminal Sanctions, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government of the National Assembly,
18. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Party of United Pensioners of Serbia (PUPS) Parliamentary Group,
19. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the United Regions of Serbia Parliamentary Group and
20. Proposal of the Decision amending the Decision on the on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by the National Assembly Speaker.

By a majority of votes, the National Assembly accepted the proposal of MP Zoran Babic to complete a joint debate in principle and single debate on items 2, 3 and 4 on the agenda; joint debate in principle on items 5, 6, 7, 8, 9, 10, 11 and 12 on the agenda; joint debate in principle on items 14, 15 and 16 on the agenda, as well as a joint single debate items 17, 18, 19 and 20 on the agenda for the sitting.

The National Assembly went on to debate the Bill amending the Budget System Law, in principle, which was elaborated by Istvan Pasztor, Speaker of the Assembly of the Autonomous Province of Vojvodina, representative of the submitter.

By the end of the daily proceedings the National Assembly had concluded the debate in principle on the Bill amending the Budget System Law.

On the second day of work, 23 November, the National Assembly conducted a joint debate in principle and a joint single debate on the Republic of Serbia 2013 Budget Bill, with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2013 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2013 Financial Plan, Bill amending and modifying the Corporate Income Tax Law and the Bill amending and modifying the Excise Tax Law.

The 2013 Budget Bill and its accompanying documents, as well as the bills amending and modifying the Corporate Income Tax Law and the Excise Tax Law, were elaborated by the Minister of Finance and Economy, Mladjan Dinkic.

On the third day of work, 26 November, the National Assembly continued and concluded the joint debate in principle and joint single debate on the Republic of Serbia 2013 Budget Bill, with its accompanying documents, Bill amending and modifying the Corporate Income Tax Law and the Bill amending and modifying the Excise Tax Law.

On the fourth day of work, 29 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Neven Cveticanin, Mirko Cikiriz, Judita Popovic, Milica Radovic, Dusan Milisavljevic and Dragan Sormaz requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly continued the proceedings with a debate on the particulars on the Republic of Serbia 2013 Budget Bill, with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2013 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2013 Financial Plan.

For the remainder of the day the National Assembly conducted the debate on the particulars on the Republic of Serbia 2013 Budget Bill and its accompanying documents.


On the fifth day of work, 30 November, the National Assembly continued the proceedings with a debate on the particulars on the Republic of Serbia 2013 Budget Bill and its accompanying documents.

In the morning part of the proceedings, at the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the termination of the terms of office of MPs Oliver Dulic and Snezana Malovic, before the expiry of the term they were elected for.

The Chair, National Assembly Deputy Speaker Vesna Kovac, reminded the MPs of the provision of article 175 paragraph 3 of the National Assembly Rules of Procedure, according to which the National Assembly Speaker may schedule the Voting Day on the budget proposal during the sitting of the National Assembly, regardless of whether or not the debate in principle and in detail on other items on the agenda has been concluded.

Pursuant to the provision, National Assembly Deputy Speaker Vesna Kovac set Saturday, 1 December 2012 as Voting Day on the Republic of Serbia 2013 Budget Bill, with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2013 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2013 Financial Plan, at 9 am.

Voting Day

On Voting Day, 1 December 2012, the National Assembly adopted the Republic of Serbia 2013 Budget Bill, with its accompanying Proposal of the Decision granting consent to the Republic Pension and Disability Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Republic Health Insurance Fund 2013 Financial Plan, Proposal of the Decision granting consent to the Fund for Social Insurance of Military Insured 2013 Financial Plan and the Proposal of the Decision granting consent to the National Employment Service 2013 Financial Plan.

On the seventh day of work, 3 December, the National Assembly conducted a joint debate in principle on the Bill on Payment Deadlines in Commercial Transactions, Bill on Conditional Write-off of Interest and Tax Debt Dormancy, Bill amending and modifying the Law on Foreign Currency Transactions, Bill on Public Enterprises, Bill amending and modifying the Republic of Serbia Development Fund Law, Bill amending and modifying the Privatisation Law, Bill on Default Interest and the Bill amending the Insurance Law, which were explained to the MPs by the Minister of Finance and Economy, Mladjan Dinkic.

On the eighth day of work, 4 December, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Olena Papuga, Zoran Ostojic, Mirko Cikiriz, Nevena Adzemovic, Borisav Kovacevic, Slavica Saveljic, Dejan Mihajlov, Dr Marko Atlagic and Borislav Stefanovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly continued the proceedings with a joint debate in principle on items 5, 6, 7, 8, 9, 10, 11 and 12 on the agenda.

On the ninth day of work, 5 December, the National Assembly continued and completed the joint debate in principle on items 5, 6, 7, 8, 9, 10, 11 and 12 on the agenda.
The National Assembly went on to conduct and conclude a debate in principle on the Bill amending and modifying the Law on Copyright and Related Rights.
For the remainder of the day the National Assembly conducted a joint debate in principle on the Bill on the Assumption of Obligations of Health Care Institutions toward Wholesale Pharmacies arising from Procurement of Medicines and Medical Material and Transforming Said Obligations into the Public Debt of the Republic of Serbia, Bill amending and modifying the Health Care Law, and the Bill amending and modifying the Health Insurance Law.
The bills were elaborated by the Minister of Health, Prof. Dr Slavica Djukic Dejanovic.

On the tenth day of work, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Aleksandar Jugovic, Aleksandra Jerkov, Zoran Ostojic, Slobodan Samardzic, Predrag Mijatovic and Ivan Jovanovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly continued the proceedings with a joint debate in principle on the Bill on the Assumption of Obligations of Health Care Institutions toward Wholesale Pharmacies arising from Procurement of Medicines and Medical Material and Transforming Said Obligations into the Public Debt of the Republic of Serbia, Bill amending and modifying the Health Care Law and the Bill amending and modifying the Health Insurance Law, which were explained by the Minister of Health, Slavica Djukic Dejanovic.

At the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the termination of the terms of office of MPs Gojko Radic and Mirko Cvetkovic, before the expiry of the term they were elected for.

By the end of the day, the National Assembly had completed the joint debate in principle on items 14, 15 and 16 on the agenda for the sitting, as well as a joint debate in principle on items 17, 18, 19 and 20 on the agenda for the sitting, i.e. the Proposal of the Decision on the Election of Members of the Commission for the Control of the Execution of Criminal Sanctions, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Party of United Pensioners of Serbia (PUPS) Parliamentary Group, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the United Regions of Serbia Parliamentary Group and the Proposal of the Decision amending the Decision on the on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions.

On the eleventh day of work, 11 December, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Aleksandar Jugovic, Dr Slobodan Samardzic, Miljenko Dereta and Radoslav Milovanovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

In the morning part of the proceedings, the National Assembly conducted and concluded a debate in detail on the Bill amending the Budget System Law.

Based on the Decision of the Republic Electoral Commission and at the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the verification of the terms of office of MPs Aleksandar Senic and Biljana Hasanovic Korac, elected from the CHOICE FOR BETTER LIFE - BORIS TADIC Electoral List. The MPs proceeded to take the oath of office.

The Chair, National Assembly Deputy Speaker Vesna Kovac, informed the MPs that part of the sitting would be attended by the students of the Faculty of Law of the University of Pristina, with headquarters in Kosovska Mitrovica.

By the end of the day, the National Assembly had conducted and concluded a debate in detail on the Bill amending and modifying the Corporate Income Tax Law, Bill amending and modifying the Excise Tax Law, Bill on Payment Deadlines in Commercial Transactions, Bill on Conditional Write-off of Interest and Tax Debt Dormancy and the Bill amending and modifying the Law on Foreign Currency Transactions.

On the twelfth day of work, 12 December, the National Assembly continued and concluded the debate in detail on the Bill on Public Enterprises.

Based on the Decision of the Republic Electoral Commission and at the proposal of the Committee on Administrative, Budgetary, Mandate and Immunity Issues, the National Assembly noted the verification of the terms of office of MPs Vesna Rakonjac, elected from the LET’S GET SERBIA MOVING – TOMISLAV NIKOLIC Electoral List, and Srdjan Milivojevic, elected from the CHOICE FOR BETTER LIFE - BORIS TADIC Electoral List. The MPs proceeded to take the oath of office.

Before recess, the National Assembly had conducted and concluded a debate in detail on the Bill amending and modifying the Republic of Serbia Development Fund Law.

By the end of the day, the National Assembly had conducted and concluded a debate in detail on the Bill amending and modifying the Privatisation Law, Bill on Default Interest, Bill amending the Insurance Law and the Bill amending and modifying the Law on Copyright and Related Rights.

On the thirteenth day of work, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Elvira Kovacs, Olgica Batic, Nevena Stojanovic, Radmila Gerov, Slavica Saveljic, Slobodan Samardzic, Zoran Radovanovic and Veroljub Arsic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

By the end of the day, the National Assembly had completed a debate in detail on items 14, 15 and 16 on the agenda i.e. the Bill on the Assumption of Obligations of Health Care Institutions toward Wholesale Pharmacies arising from Procurement of Medicines and Medical Material and Transforming Said Obligations into the Public Debt of the Republic of Serbia, Bill amending and modifying the Health Care Law and the Bill amending and modifying the Health Insurance Law.

On the fourteenth day of work, 15 December, pursuant to article 168, paragraph 3, of the National Assembly Rules of Procedure, the National Assembly Speaker, MA Nebojsa Stefanovic, proposed that the Proposal of the Decision amending the Decision on the on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by the National Assembly Speaker, be included into the agenda for the sitting under urgent procedure.

The National Assembly accepted the proposal by a majority of votes and proceeded to complete a single debate on the Decision Proposal.

As the National Assembly had completed the debate on all the items on the agenda for the sitting, and having already voted on item 2 on the agenda – the Republic of Serbia 2013 Budget Bill, the National Assembly Speaker, MA Nebojsa Stefanovic, set Saturday, 15 November 2012, as Voting Day on the remaining items on the agenda for the Eighth Sitting of the Second Regular Session of the National Assembly in 2012, starting at 9.25 am.

Voting Day

On Voting Day, 15 December 2012, the National Assembly adopted the Bill amending and modifying the Corporate Income Tax Law, Bill amending and modifying the Excise Tax Law, Bill on Payment Deadlines in Commercial Transactions, Bill on Conditional Write-off of Interest and Tax Debt Dormancy, Bill amending and modifying the Law on Foreign Currency Transactions, Bill on Public Enterprises, Bill amending and modifying the Republic of Serbia Development Fund Law, Bill amending and modifying the Privatisation Law, Bill on Default Interest, Bill amending the Insurance Law, Bill amending and modifying the Law on Copyright and Related Rights, Bill on the Assumption of Obligations of Health Care Institutions toward Wholesale Pharmacies arising from Procurement of Medicines and Medical Material and Transforming Said Obligations into the Public Debt of the Republic of Serbia, Bill amending and modifying the Health Care Law, and the Bill amending and modifying the Health Insurance Law, by a majority of votes.

The National Assembly also adopted the Proposal of the Decision on the Election of Members of the Commission for the Control of the Execution of Criminal Sanctions, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, and two Proposals of the Decision amending the Decision on the on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, by a majority of votes.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, the National Assembly Speaker, MA Nebojsa Stefanovic, concluded the Eighth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2012.
