Doing AI the European Way: Protecting Fundamental Rights in an Era of Artificial Intelligence

At the invitation of the European Union Agency for Fundamental Rights, National Assembly Deputy Speaker Dr Vladimir Orlic and the Chairperson of the Committee on Constitutional and Legislative Issues Jelena Zaric Kovacevic participated in the online conference “Doing AI the European way: Protecting fundamental rights in an era of artificial intelligence” on 14 December 2020.

The conference was organised by the European Union Agency for Fundamental Rights and the German Federal Ministry of Justice and Consumer Protection.

Christine Lambrecht, German Federal Minister of Justice and Consumer Protection, Michael O’ Flaherty, Director of the European Union Agency for Fundamental Rights, and Didier Reynders, EU Commissioner for Justice, were among the keynote speakers.

Following the introductory speech the participants were be presented the EU Agency for Fundamental Rights’ report entitled “Getting the Future Right – Artificial Intelligence and Fundamental Rights in the EU”. The experts who worked on the report presented the key points mentioned in it: defining artificial intelligence (AI), cases of application of AI in the European Union, purpose of using AI, legislative framework for fundamental rights, data protection, equality and non-discrimination, access to an effective remedy and assessment of the impact of AI in practice and under what conditions.

In the first panel "Automating Public Administration - Public sector use of AI and fundamental rights implications", the panellists spoke about use cases of AI in the public sector, benefits, challenges and possible solutions to fundamental rights issues concerning the use of AI in the public sector.

The second panel "Business Models and AI - Private sector use of AI and fundamental rights implications" was an opportunity to discuss the challenges of using AI by companies and the impact this has on fundamental rights.

The third panel "AI and the EU policy agenda - How to drive forward a fundamental rights compatible EU framework regulating AI", emphasized the need to use artificial intelligence in accordance with fundamental rights in the European Union. The panellists indicated that a draft EU legislative framework regulating AI would be presented in the first quarter of 2021. The Council of Europe was also said to be planning a discussion in the upcoming days on whether it is necessary to adopt a charter on artificial intelligence and the attending were reminded that the European Commission’s Digital Services Act would be presented tomorrow.
