Chairman of Committee on Constitutional and Legislative Issues Meets with EU Delegation to Serbia

The Chairman of the Committee on Constitutional and Legislative Issues Djordje Komlenski met today with the EU Delegation to Serbia to discuss Chapter 23 – Judiciary and Fundamental Rights and possible amendments to the Constitution of the Republic of Serbia.

Delegation members Noora Hayrinen, Mateja Norcic and Mirjana Cvetkovic were interested in the technical aspects of amending the Constitution and Constitutional Law from the moment of entry into parliamentary procedure and the Assembly’s responsibilities in that respect.

Komlenski explained the three potential methods in which a proposal to amend the Constitution can reach the National Assembly which then the Assembly rules on, the fact that the motion to amend the Constitution is passed by a two-thirds majority of all the members of parliament and if the vote does not yield the needed majority the Constitution cannot be amended per issues contained within the submitted proposal within the next year.

The Committee Chairman went on to explain that if the National Assembly passes the decision to amend the Constitution, this is followed by the drafting and deliberation on the act to amend the Constitution and the Assembly then passes the act to amend the Constitution by a two-thirds majority of all the members of parliament, but may also decide that the citizens vote on it in a referendum.

The National Assembly is obliged to call a nationwide referendum to endorse the act to amend the Constitution when the amendment pertains to the Preamble of the Constitution, the principles of the Constitution, human and minority rights and freedoms, the system of authority, proclamation of the state of war or emergency, derogation from human and minority rights during the state of emergency or war, or the proceedings for amending the Constitution.

The Committee Chairman explained how the National Assembly’s Committee on Constitutional and Legislative Issues operates and the technical matters it deals with concerning legislative proposals or the supreme law of the land.

The members of the EU Delegation to Serbia thanked the Committee Chairman for his time asking if they may have additional meetings in case any questions arise concerning the supreme law.
