44th Sitting of the Committee on Constitutional and Legislative Issues
At the sitting held on 24 August 2026, the members of the Committee on Constitutional and Legislative Issues considered the bills proposed for the agenda of the the 10th Extraordinary Session of the National Assembly of the Republic of Serbia, 14th Legislature.
By majority vote, the Committee members ruled to complete a joint debate in principle; and single debate on items 1 to 49 on the agenda of the session, pursuant to Article 76 and in line with Article 57, paragraph 2 on the National Assembly Rules of Procedure.
The Committee considered the following:
- Bill amending and modifying the Republic of Serbia 2026 Budget Law, with its accompanying Proposal of the Decision to grant consent to the Decision amending and modifying the Republic Pension and Disability Insurance Fund 2026 Financial Plan, Proposal of the Decision to grant consent to the Decision amending and modifying the Republic Health Insurance Fund 2026 Financial Plan, Proposal of the Decision to grant consent to the Decision amending and modifying the Fund for Social Insurance of Military Insured 2026 Financial Plan and the Proposal of the Decision to grant consent to the Decision amending and modifying the National Employment Service 2026 Financial Plan, submitted by the Government, in principle;
- Bill on Mitigating the Consequences of the Energy Crisis Rising Living Costs for Certain Population Groups through One-off Financial Support and a One-off Cash Payment, submitted by the Government, in principle;
- Bill amending the Law Determining Public Interest and Special Procedures of Expropriation and Issuance of the Building Permit for the Realisation of Project Belgrade Waterfront, submitted by the Government, in principle;
- Bill amending and modifying the Public Debt Law, submitted by the Government, in principle;
- Bill amending and modifying the Law on Electronic Delivery Notes, submitted by the Government, in principle;
- Bill amending and modifying the Law on Electronic Invoicing, submitted by the Government, in principle;
- Bill amending and modifying the Fiscalisation Law, submitted by the Government, in principle;
- Bill amending the Excise Tax Law, submitted by the Government, in principle;
- Bill amending and modifying the Law on Tax Procedure and Tax Administration, submitted by the Government, in principle;
- Bill amending and modifying the Law on Greenhouse Gas Emissions Tax, submitted by the Government, in principle;
- Bill amending the Law on Tax on Imports of Carbon-Intensive Products, submitted by the Government, in principle;
- Bill amending and modifying the Budget System Law, submitted by the Government, in principle;

- Bill amending and modifying the Law on Public Notaries, submitted by the Government, in principle;

- Bill on the Borrowing of the Republic of Serbia from AikBanka Joint Stock Company Belgrade, OTP Banka Srbija Joint Stock Company Novi Sad, Banca Intesa AD Belgrade and UniCredit Bank Srbija ad Belgrade for Financing Needs of Highway Construction Project, Section Backi Breg - Sombor - Kikinda, submitted by the Government, in principle;
- Bill on the Borrowing of the Republic of Serbia from UniCredit Bank Serbia ad Belgrade for the Financing Needs of Highway Construction Project, Section Belgrade - Zrenjanin - Novi Sad, submitted by the Government, in principle;
- Bill on the Borrowing of the Republic of Serbia from Banca Intesa AD Belgrade for the Financing Needs of Highway Construction Project, Section Belgrade – Zrenjanin – Novi Sad, submitted by the Government, in principle;
- Bill on the Borrowing of the Republic of Serbia from Banca Intesa AD Belgrade for the Financing Needs of Highway Construction Project, Section Pozarevac - Golubac (Danube Highway), submitted by the Government, in principle;
- Bill on the Provision of Guarantee by the Republic of Serbia in favour of Postal Savings Bank, Joint Stock Company, Belgrade, for the Settlement of the Obligations of the Joint Stock Company for the Transport of Oil through Oil Pipelines and the Transport of Oil Derivatives through Product Pipelines Transnafta Pancevo, on the Basis of a Long-Term Loan Agreement for the Construction of the Serbia - Hungary Oil Pipeline, submitted by the Government;
- Bill on the Borrowing of the Republic of Serbia from NLB KOMERCIJALNA BANKA AD BELGRADE for the Financing Needs of Highway Construction Project, Section Belgrade - Zrenjanin - Novi Sad, submitted by the Government, in principle;
- Bill on the Confirmation of the Agreement between the Republic of Serbia and the Republic of Angola on Elimination of Double Taxation with respect to Taxes on Income and Prevention of Tax Evasion and Avoidance, submitted by the Government;
- Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the People's Democratic Republic of Algeria on Elimination of Double Taxation with respect to Taxes on Income and Property and Prevention of Tax Evasion and Avoidance, submitted by the Government;
- Bill on the Confirmation of the Framework Loan Agreement LD 1981 ADD 2 (2026) between the Council of Europe Development Bank and the Republic of Serbia - Public Sector Financing Facility - Renovation of Health Centres, submitted by the Government;
- Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the Republic of Azerbaijan on Cooperation in the Field of Food Safety, submitted by the Government;
- Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the People's Democratic Republic of Algeria on Cooperation in the Field of Plant Protection and Plant Quarantine, submitted by the Government;
- Bill on the Confirmation of the General Agreement on the Privileges and Immunities of the International Criminal Police Organisation – INTERPOL, submitted by the Government, in principle;
- Bill on the Confirmation of the Protocol on Explosive Remnants of War to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons which may be deemed to be Excessively Injurious or to have Indiscriminate Effects (Protocol V), submitted by the Government;
- Giving an opinion to the Constitutional Court regarding the initiative to launch proceedings to assess the constitutionality of the provisions of Article 123, paragraphs 7, 8, and 11 of the Law amending and modifying the Energy Law (“RS Official Gazette” no.94/24);
- Giving an opinion to the Constitutional Court regarding the launched proceedings to assess the unconstitutionality of the launched initiatives to assess the unconstitutionality of the provisions of Article 18 and Article 25, paragraph 1 of the Law on the Procedure for Registration in the Real Estate Cadastre and Infrastructure Cadastre (“RS Official Gazette” no.41/18, 95/18, 31/19, 15/20 and 92/23) and the initiative to launch proceedings to assess the constitutionality of the provisions of Article 25, paragraph 1 and Article 59, paragraph 1 of the same Law;
- Giving an opinion to the Constitutional Court regarding the initiative to launch proceedings to assess the constitutionality and legality of the Law on Simplified Work Engagement on Seasonal Jobs in Certain Activities (“RS Official Gazette” no.50/18);
- Giving an opinion to the Constitutional Court regarding the launched proceedings to assess the compliance of the provisions of the Law on Special Procedures for or the realisation of the project of revitalisation and development of the location between Kneza Milosa, Masarikova, Bircaninova and Resavska streets (“RS Official Gazette” no.96/25 and 108/25 – authentic interpretation) with the Constitution of the Republic of Serbia , i.e. a number of initiatives to launch proceedings to assess the constitutionality and compliance with ratified international agreements of the provisions of said law, with one initiative bringing into question the constitutionality of the authentic interpretation of Article 9 of the Law on Special Procedures for or the realisation of the project of revitalisation and development of the location between Kneza Milosa, Masarikova, Bircaninova and Resavska streets (“RS Official Gazette” no.96/25) published in “RS Official Gazette” no. 108/25.
Following a debate, the Committee found all the bills to be compliant with the Constitution and legal system of the Republic of Serbia.
By majority vote, the Committee decided to forward an opinion to the Constitutional Court regarding the initiative to launch proceedings to assess the constitutionality of the provisions of Article 123, paragraphs 7, 8, and 11 of the Law amending and modifying the Energy Law (“RS Official Gazette” no.94/24).
Also by majority vote, the Committee decided to forward an opinion to the Constitutional Court regarding the launched proceedings to assess the unconstitutionality of the launched initiatives to assess the unconstitutionality of the provisions of Article 18 and Article 25, paragraph 1 of the Law on the Procedure for Registration in the Real Estate Cadastre and Infrastructure Cadastre (“RS Official Gazette” no.41/18, 95/18, 31/19, 15/20 and 92/23) and the initiative to launch proceedings to assess the constitutionality of the provisions of Article 25, paragraph 1 and Article 59, paragraph 1 of the same Law.
By majority vote, the Committee decided to forward a response to the Constitutional Court regarding the initiative to launch proceedings to assess the constitutionality and legality of the Law on Simplified Work Engagement on Seasonal Jobs in Certain Activities (“RS Official Gazette” no.50/18).
Also by majority vote, the Committee decided to forward an opinion i.e. a response to the Constitutional Court regarding the launched proceedings to assess the compliance of the provisions of the Law on Special Procedures for or the realisation of the project of revitalisation and development of the location between Kneza Milosa, Masarikova, Bircaninova and Resavska streets (“RS Official Gazette” no.96/25 and 108/25 – authentic interpretation) with the Constitution of the Republic of Serbia , i.e. a number of initiatives to launch proceedings to assess the constitutionality and compliance with ratified international agreements of the provisions of said law, with one initiative bringing into question the constitutionality of the authentic interpretation of Article 9 of the Law on Special Procedures for or the realisation of the project of revitalisation and development of the location between Kneza Milosa, Masarikova, Bircaninova and Resavska streets (“RS Official Gazette” no.96/25) published in “RS Official Gazette” no. 108/25.
