42nd session of the Legislative Committee

At its session held on 22 October, the Legislative Committee of the National Assembly of the Republic of Serbia discussed, at the request of the Constitutional Court of the Republic of Serbia, motions for assessing the constitutionality and initiatives for instituting proceedings to assess the constitutionality of the Act on the Rights of Indictees Detained at the International Criminal Tribunal and Members of their Families.


At its session held on 22 October, the Legislative Committee of the National Assembly of the Republic of Serbia discussed, at the request of the Constitutional Court of the Republic of Serbia, motions for assessing the constitutionality and initiatives for instituting proceedings to assess the constitutionality of the Act on the Rights of Indictees Detained at the International Criminal Tribunal and Members of their Families. The motions were submitted by the Vojvodina Bar Association, the Pozega Municipal Assembly, and the Committee of Human Rights Lawyers, while several private individuals submitted initiatives for instituting proceedings to assess the constitutionality of the Act. The Legislative Committee ruled that the initiatives were unfounded, while opinions on each individual motion and initiative will be submitted to the Constitutional Court of the Republic of Serbia separately.

The session’s agenda also included an official document from the Education Committee of the National Assembly of the Republic of Serbia asking the Legislative Committee for its opinion on the manner of electing members of the National Education Council. The Legislative Committee adopted the view that, if bodies mentioned in Article 11 of the Act on the Elementary Education System fail to submit lists of candidates, the candidates may be put forward by deputies to the National Assembly.
