Working Group for the Improvement of the Electoral Process Submits Two Amendment Proposals to the Law on the Unified Electoral Roll for the Purpose of Organising Public Hearing

The Working Group for the Improvement of the Electoral Process submitted two proposals for amendments to the Law on the Unified Electoral Roll to the National Assembly Committee on Constitutional and Legislative Issues on 16 January 2025. They are the proposals submitted by Working Group members Pavle Dimitrijevic (CRTA), on 19 December 2024, and Ugljesa Mrdic (SNS), on 26 December 2024.


The proposals are drafted to address the following ODIHR recommendations: 7:2017, 13:2017, 6:2020, 10:2020, 16:2020, 3:2022, 4:2023 and 3:2024.

The Working Group for the Improvement of the Electoral Process considered both of the abovementioned proposals at its seventh meeting, held on 18, 26 and 27 December 2024, and then proceeded to the vote. Seven members and/or substitute members of the Working Group with the right to vote (Ana Jakovljevic, Jelena Jerinic, Filip Tatalovic, Aleksandar Stevanovic, Bojan Klacar, Nemanja Nenadic and Pavle Dimitrijevic) voted in favour of the proposal of Pavle Dimitrijevic, eight members, and/or substitut members of the Working Group with the right to vote (Marko Milosevic, Risto Kostov, Luka Pusic, Uros Kandic, Zagorka Aleksic, Djordje Komlenski, Edin Numanovic and Ugljesa Mrdic) voted in favour of the proposal of Ugljesa Mrdic, while Working Group member Ana Krstic abstained. Of the two members of the Working Group who did not attend the meeting, Ahmedin Skrijelj previously informed the Chairman that he was unable to come to Belgrade on the day set of the vote. The Decision on the Establishment of the Working Group for the Improvement of the Electoral Process, as well as the National Assembly Rules of Procedure, the provisions of which apply accordingly to the work of the Working Group, currently do not provide for the possibility of participating in the work and voting via means of remote communication.

Since, in accordance with the provisions of the Decision on the Establishment of the Working Group for the Improvement of the Electoral Process, in this specific case it was necessary for one of the proposals to receive at least 10 votes, the Chairman of the Working Group noted that neither of the proposals was adopted.

Given that item 6, paragraph 4 of the Decision stipulates the following: "If no proposal relating to the same legal provision or several interconnected provisions, or to the same measure, receives the required majority of votes for adoption, the proposals shall be agreed upon within the Working Group.", and there was no willingness to proceed with the agreement immediately after the vote at the Working Group meeting, the proposers were given a new deadline, 30 December 2024, to agree on their proposals or to inform the Working Group that the agreement between them had failed. It was also determined that, in the event of a possible agreed proposal being submitted, that proposal would be considered at a new meeting of the Working Group.

Although the proposers informed the Working Group on 31 December 2024, that there had been a "convergence of views" among them and that they would submit a "notification of the outcome, i.e. the agreed text" within 10-15 days (which included holidays), this had not happened by 15 January 2025.

In view of the above, and bearing in mind the provision of item 6, paragraph 5 of the Decision, which stipulates the following: "If, even after coordination, a decision is not made on the proposal for full or partial fulfilment of the recommendation, the Committee on Constitutional and Legislative Issues shall be submitted an act with the two proposals that received the highest number of votes, but which did not receive the required majority of votes for adoption," both of the aforementioned proposals were submitted to the Committee for further action.

In a cover letter to the Committee, the Chairman of the Working Group, Nemanja Nenadic, reminded that item 10 of the Decision stipulates that the Committee on Constitutional and Legislative Issues will organise one or more public hearings on the prepared working versions of amendments to the law submitted by the Working Group, in accordance with articles 83 and 84 of the National Assembly Rules of Procedure, with a prior invitation to all interested parties to submit written comments on the working versions of amendments to the law, taking into account that item 9, paragraph 2 of the Decision sets 1 July 2025 as the deadline by which all necessary laws should be adopted by the National Assembly.

In this regard, the Chairman called on the Committee on Constitutional and Legislative Issues to publish as soon as possible an invitation to all interested parties to submit their comments on the draft versions, i.e. the submitted proposals for amendments to the Law on the Unified Electoral Roll, to set the date and venue of the public hearing and to enable the participation of all interested parties in the public hearing.
