Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2017

The Speaker of the National Assembly of the Republic of Serbia Maja Gojkovic convened the Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2017, for Thursday, 11 May, at 10 am.


Before moving on to the agenda, the heads i.e. authorized representatives of the parliamentary groups, MPs Djordje Vukadinovic, Milija Miletic, Olena Papuga, Bosko Obradovic, Marko Djurisic, Balsa Bozovic, Prof. Dr Vojislav Seselj, Sasa Radulovic and Zika Gojkovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly went on to adopt the following agenda:

  1. Bill amending and modifying the Law on Judges, submitted by MP Dr Aleksandar Martinovic;
  2. Bill on the Confirmation of the Loan Agreement (First Public Expenditure and Public Utilities Development Policy Loan) between the Republic of Serbia and the International Reconstruction and Development Bank, submitted by the Government;
  3. Bill on the Confirmation of the Financing Agreement “Improvement of Judicial Facilities B” between the Republic of Serbia and the European Investment Bank, submitted by the Government;
  4. Proposal of the Decision on the termination of office of High Judicial Council member from the ranks of Faculty of Law professors, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government;
  5. Proposal of the Decision on the termination of office of President of the Commercial Appellate Court, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government;
  6. Proposal of the Decision on the termination of office of public prosecutor at the Appellate Public Prosecutor’s Office in Nis, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government;
  7. Proposal of the Decision on the termination of office of public prosecutor at the Basic Public Prosecutor’s Office in Cacak, submitted by the Committee on the Judiciary, Public Administration and Local Self-Government;
  8. Proposal of candidates for High Judicial Council member, submitted by the deans of law faculties in the Republic of Serbia, at a joint session;
  9. Proposal of the Decision on the election of court presidents, submitted by the High Judicial Council;
  10. Proposal of the Decision on the election of judges to judicial office for the first time, submitted by the High Judicial Council;
  11. Candidate List for the election of War Crimes Prosecutor, submitted by the Government;
  12. Candidate List for the election of public prosecutor at the Higher Public Prosecutor’s Office in Pancevo, submitted by the Government;

  40. Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Mionica, submitted by the Government,
  41. Proposal of the Decision on the election of deputy public prosecutor, submitted by the State Prosecutorial Council;
  42. Proposal of an authentic interpretation of the provision of Article 82, paragraph 1, item 2, of the Law on State Survey and Cadastre (“RS Official Gazette”, no. 72/09, 18/10, 65/13, 15/15-US and 96/15), submitted by the Committee on Constitutional and Legislative Issues;
  43. Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Serbian Radical Party Parliamentary Group; and
  44. Proposal of the Decision amending the Decision on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by National Assembly Speaker Maja Gojkovic.
The National Assembly accepted the proposal of MP Dr Aleksandar Martinovic to complete a joint debate in principle and single debate on items 1 through 42 on the agenda.

After recess, the National Assembly commenced the joint debate in principle and single debate on items 1 through 42 on the agenda, presented to the MPs by the representatives of the submitter Dr Aleksandar Martinovic, Minister of Justice Nela Kuburovic and Chairman of the Committee on the Judiciary, Public Administration and Local Self-Government Petar Petrovic.

On the second day of the proceedings, 12 May, the National Assembly continued and concluded the joint debate in principle and single debate on items 1 through 42 on the agenda.

The National Assembly went on to conduct and conclude a joint single debate on items 43 and 44 on the agenda.

On the third day of the proceedings, 15 May, the National Assembly conducted and concluded the debate in detail on the Bill amending and modifying the Law on Judges.

Having completed the debate in principle and in detail on all the items on the agenda of the Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2017, the Chair, National Assembly Deputy Speaker Veroljub Arsic set Monday, 15 May 2017, as Voting Day on all the items on the agenda, starting at 3:20 pm.

Voting Day

On Voting Day, by majority vote, the National Assembly passed the Bill amending and modifying the Law on Judges, Bill on the Confirmation of the Loan Agreement (First Public Expenditure and Public Utilities Development Policy Loan) between the Republic of Serbia and the International Reconstruction and Development Bank, Bill on the Confirmation of the Financing Agreement “Improvement of Judicial Facilities B” between the Republic of Serbia and the European Investment Bank, Proposal of the Decision on the termination of office of High Judicial Council member from the ranks of Faculty of Law professors, Proposal of the Decision on the termination of office of President of the Commercial Appellate Court, Proposal of the Decision on the termination of office of public prosecutor at the Appellate Public Prosecutor’s Office in Nis, and the Proposal of the Decision on the termination of office of public prosecutor at the Basic Public Prosecutor’s Office in Cacak.

By majority vote, the MPs elected Dr Ranko Keca High Judicial Council member at the proposal of the deans of law faculties in the Republic of Serbia.

The National Assembly did not elect Marina Zivkovic President of the Higher Court in Pirot, or Natalija Bobot President of the First Basic Court in Belgrade, while the rest of the candidates in the Proposal of the Decision on the election of court presidents were elected.

The National Assembly proceeded to adopt the Proposal of the Decision on the election of judges to judicial office for the first time, by majority vote.

By majority vote, the MPs elected Snezana Stanojkovic War Crimes Prosecutor.

By majority vote, the MPs elected Nebojsa Zivkovic public prosecutor at the Higher Public Prosecutor’s Office in Pancevo, and did not elect any of the candidates for public prosecutor at the Higher Public Prosecutor’s Office in Pozarevac.

By majority vote, the National Assembly adopted the Proposal of the Decision on the election of public prosecutor at the Higher Public Prosecutor’s Office in Zajecar, and the Proposal of the Decision on the election of public prosecutor at the Higher Public Prosecutor’s Office in Pirot.

By majority vote, the MPs elected Sasa Djokic public prosecutor at the Basic Public Prosecutor’s Office in Nis, and Ivan Konatar public prosecutor at the Basic Public Prosecutor’s Office in Mladenovac.

The National Assembly elected Bravislav Lepotic public prosecutor at the Basic Public Prosecutor’s Office in Vrbas, and Vladimir Nikolic public prosecutor at the Basic Public Prosecutor’s Office in Stara Pazova.

By majority vote, Slavica Ivanovic was elected public prosecutor at the Basic Public Prosecutor’s Office in Velika Plana, while none of the candidates for public prosecutor at the Basic Public Prosecutor’s Office in Prijepolje was elected.

The National Assembly elected Nermin Koskovac public prosecutor at the Basic Public Prosecutor’s Office in Novi Pazar, by majority vote.

The MPs adopted the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Zajecar.

The MPs did not adopt the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Vranje.

By majority vote, the National Assembly adopted the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Aleksinac. The National Assembly did not adopt the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Petrovac na Mlavi. The National Assembly adopted, by majority vote, the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Despotovac, while the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Sabac and the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Pirot were not adopted.

The National Assembly went on to adopt the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Negotin, Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Kursumlija, Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Ruma and the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Sombor.

The National Assembly did not adopt the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Brus, Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Bor, Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Prokuplje, Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Loznica and the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Pancevo.

By majority vote, the MPs adopted the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Valjevo and the Proposal of the Decision on the election of public prosecutor at the Basic Public Prosecutor’s Office in Mionica.

At the proposal of the State Prosecutorial Council, the National Assembly adopted the Proposal of the Decision on the election of deputy public prosecutor, by majority vote.

By majority vote, the MPs passed the Proposal of an authentic interpretation of the provision of Article 82, paragraph 1, item 2, of the Law on State Survey and Cadastre, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Serbian Radical Party Parliamentary Group, and the Proposal of the Decision amending the Decision on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, submitted by National Assembly Speaker Maja Gojkovic.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the sitting and decided that none of the provisions of the Rules of Procedure had been violated.

As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Deputy Speaker Veroljub Arsic concluded the Third Sitting of the First Regular Session of the National Assembly of the Republic of Serbia in 2017.
