Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2009

The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2009, for Monday, 21 December 2009, starting at 2 p.



The Speaker of the National Assembly of the Republic of Serbia, Prof. Dr Slavica Djukic-Dejanovic, convened the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2009, for Monday, 21 December 2009, starting at 2 p.m.

The National Assembly adopted the following schedule:

1. The Bill on Emergency Situations, submitted by the Government;

2. The Bill on Protection Against Fire, submitted by the Government;

3. The Bill modifying the Law on the Security Information Agency, submitted by the Government;

4. The Bill amending and modifying the Criminal Code, submitted by the Government;

5. The Bill amending and modifying the Civil Procedure Act, submitted by the Government;

6. The Bill on Administrative Disputes, submitted by the Government;

7. The Bill amending and modifying the Misdemeanor Law, submitted by the Government;

8. The Bill amending and modifying the Law on the Prevention of Violence and Inappropriate Behaviour at Sporting Events, submitted by the Government;

9. The Bill amending the Law on Real Estate Transfer, submitted by the Government;

10. The Bill on the Expiration of the Law on Organisation and Operation of Economic Units of Institutions for the Execution of Penal Sanctions, submitted by the Government;

11. The Bill amending and modifying the Republic of Serbia 2009 Budget Law, submitted by the Government;

12. The Bill amending and modifying the Accounting and Auditing Law, submitted by the Government;

13. The Bill amending and modifying the Business Registers Agency Law, submitted by the Government;

14. The Proposal of the Decision on the Election of Judges for a three-year term of office at courts of general and special jurisdiction, submitted by the High Judicial Council;

15. The Proposal of the Decision on the Election of Deputy Public Prosecutor, submitted by the State Prosecutors Council;

16. The Request for the Termination of Judicial Office of Republic of Serbia Constitutional Court Judge, submitted by MA Stanka Milanovic;

17. The Proposal of the Decision on the Termination of Judicial Office, submitted by the Justice and Administration Committee;

18. The Proposal of the Decision on the Termination of Judicial Office, submitted by the Justice and Administration Committee;

19. The Proposal of the Decision on the Dismissal of Public Prosecutor, submitted by the Justice and Administration Committee;

20. The Proposal of the Decision on the Termination of Office of Public Prosecutor, submitted by the Justice and Administration Committee;

21. The Nominations for the Elective Member of the First Composition of the High Judicial Council from the ranks of law faculty professors, submitted by the Deans of the Law Faculties in the Republic of Serbia at a joint sitting;

22. The Candidate List for the Election of three members of the Council of the Republic Broadcasting Agency, submitted by the authorised submitters;

23. The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the State of Israel on the abolition of visas for their citizens, submitted by the Government;

24. The Bill on the Confirmation of the Agreement on Social Security between the Republic of Serbia and the Republic of Slovenia, submitted by the Government.

By a majority of votes, the National Assembly decided to complete a joint discussion in principle and a unified discussion on items 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 23, and on items 11, 12, 13 and 24 on the agenda for the sitting.

Having opened the joint discussion in principle and unified discussion on items 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 23, the deputies were addressed by the First Deputy Prime Minister of the Government of the Republic of Serbia, Deputy Prime Minister and Minister of Interior Ivica Dacic and the Minister of Justice Snezana Malovic who presented the proposed legal solutions.

By the end of the day the deputies had completed the joint discussion in principle and unified discussion on items 1, 2, 3, 4, 5, 6, 7, 8, 9, 10 and 23.

On the second day, 22 December, the deputies continued the session with a joint discussion in principle and unified discussion on the Bill amending and modifying the Republic of Serbia 2009 Budget Law, Bill amending and modifying the Accounting and Auditing Law, Bill amending and modifying the Business Registers Agency Law and the Bill on the Confirmation of the Agreement on Social Security between the Republic of Serbia and the Republic of Slovenia.

Before commencing the discussion on the agenda, deputies Slobodan Samardzic, Zoran Ostojic, Miroslav Markicevic and Dragan Todorovic exercised their right under article 235 of the Rules of Procedure and requested information and explanations from state institutions. The Chair, National Assembly Deputy Speaker Gordana Comic, informed the deputies that part of the sitting was being viewed from the gallery of the Great Hall of the National Assembly House by a group of high-school students from Novi Sad, members of the student parliament, whom she welcomed to the National Assembly of the Republic of Serbia.

The Bills were presented to the deputies by the Minister of Finance Diana Dragutinovic.

By the end of the day, the deputies had completed the joint discussion in principle and unified discussion on the Bill amending and modifying the Republic of Serbia 2009 Budget Law, Bill amending and modifying the Accounting and Auditing Law, Bill amending and modifying the Business Registers Agency Law and the Bill on the Confirmation of the Agreement on Social Security between the Republic of Serbia and the Republic of Slovenia.

Before concluding the joint discussion in principle and unified discussion on these items on the agenda, the National Assembly Speaker Prof. Dr Slavica Djukic-Dejanovic stressed that 22 December was a historic day for the citizens of Serbia. She informed the National Assembly that the President of the Republic of Serbia had that day officially handed in Serbia’s application for European Union membership. She was pleased that the National Assembly had celebrated that day in a working atmosphere, by which the deputies demonstrated that they cultivate European values.


On the third day of work, 23 December, the National Assembly conducted a joint unified discussion on items 14 through 22 on the agenda, viz. the Decision Proposals on: the Election of Judges for a three-year term of office at courts of general and special jurisdiction, submitted by the High Judicial Council, on the Election of Deputy Public Prosecutor, submitted by the State Prosecutors Council, on the Termination of Judicial Office, submitted by the Justice and Administration Committee, on the Termination of Judicial Office, submitted by the Justice and Administration Committee, on the Dismissal of Public Prosecutor, submitted by the Justice and Administration Committee and on the Termination of Office of Public Prosecutor, submitted by the Justice and Administration Committee, as well as the Request for the Termination of Judicial Office of Republic of Serbia Constitutional Court Judge, submitted by MA Stanka Milanovic, Nominations for the Elective Member of the First Composition of the High Judicial Council from the ranks of law faculty professors, submitted by the Deans of the Law Faculties in the Republic of Serbia at a joint sitting and the Candidate List for the Election of three members of the Council of the Republic Broadcasting Agency, submitted by the authorised submitters.

After opening the debate on the abovementioned items on the agenda, the deputies were addressed by the President of the High Judicial Council Nata Mesarovic, President of the State Prosecutors Council Slobodan Radovanovic and Chairman of the Justice and Administration Committee Bosko Ristic.

By the end of the day, the National Assembly had concluded the joint unified discussion on items 14 through 22 on the agenda.


On the fourth day of work, 24 December, the National Assembly commenced a discussion on the particulars on the Bills on the agenda.

At the beginning of the proceedings, the heads i.e. authorised representatives of the Deputy Groups, Milan Dimitrijevic, Dragan Todorovic and Zoran Ostojic requested information and/or explanations, under article 235 of the Rules of Procedure.

During the morning part of the proceedings, the National Assembly completed a discussion on the particulars on the Bill on Emergency Situations, Bill on Protection Against Fire, Bill modifying the Law on the Security Information Agency, Bill amending and modifying the Criminal Code and the Bill amending and modifying the Civil Procedure Act.

At the proposal of the Administrative Committee, the National Assembly noted the termination of term of office of deputies Elena Bozic-Talijan and Lidija Dimitrijevic, elected from the SRP - Dr Vojislav Seselj electoral list, before the expiration of the term they were elected for.

The Chair, National Assembly Deputy Speaker Gordana Comic informed the deputies that part of the sitting was being viewed from the gallery of the Great Hall by a group of students of the Academy for the Future from the territory of AP Kosovo-Metohija, visiting the National Assembly House in the organisation of the Local Community Development Centre.

By the end of the day the National Assembly had completed a discussion on the particulars on the Bill on Administrative Disputes, Bill amending and modifying the Misdemeanor Law and the Bill amending and modifying the Law on the Prevention of Violence and Inappropriate Behaviour at Sporting Events.

The Chair, National Assembly Deputy Speaker Nikola Novakovic congratulated Christmas to the deputies and citizens celebrating the holiday according to the new, Gregorian calendar.

Voting Day

On Voting Day, the National Assembly adopted the Bill on Emergency Situations, Bill on Protection Against Fire, Bill modifying the Law on the Security Information Agency, Bill amending and modifying the Criminal Code, Bill amending and modifying the Civil Procedure Act, Bill on Administrative Disputes, Bill amending and modifying the Misdemeanor Law, Bill amending and modifying the Law on the Prevention of Violence and Inappropriate Behaviour at Sporting Events, Bill amending the Law on Real Estate Transfer, Bill on the Expiration of the Law on Organisation and Operation of Economic Units of Institutions for the Execution of Penal Sanctions, by a majority of votes.

The Bill amending and modifying the Republic of Serbia 2009 Budget Law, Bill amending and modifying the Accounting and Auditing Law and the Bill amending and modifying the Business Registers Agency Law were also adopted.

By a majority of votes, the National Assembly also adopted the Proposal of the Decision on the Election of Judges for a three-year term of office at courts of general and special jurisdiction and the Proposal of the Decision on the Election of Deputy Public Prosecutor.

By a majority of votes, the National Assembly adopted the decision on the termination of judicial office of Republic of Serbia Constitutional Court Judge Stanka Milanovic and the decision proposals on the termination of judicial office no.118-2984/09 of October 6, 2009 and no.118-3451/09 of November 18, 2009.

The National Assembly also adopted the Proposal of the Decision on the Dismissal of Public Prosecutor Senad Palamar, Deputy District Prosecutor of Novi Pazar, as well as the Proposal of the Decision on the Termination of Office of Public Prosecutor of Obrad Protic, Municipal Public Prosecutor of Novi Sad.

The National Assembly did not elect Dr Zoran Tomic elective member of the first composition of the High Judicial Council from the ranks of law faculty professors, nominated by the Deans of the Law Faculties in the Republic of Serbia at a joint sitting.

By a majority of votes, the National Assembly elected three members of the Council of the Republic Broadcasting Agency, viz. Goran Karadzic at the proposal of AP Vojvodina, Svetozar Stojanovic at the proposal of the Conference of the Universities of Serbia and Bishop Porfirije Peric at the proposal of traditional churches and religious communities.

The Bill on the Confirmation of the Agreement between the Government of the Republic of Serbia and the Government of the State of Israel on the abolition of visas for their citizens and the Bill on the Confirmation of the Agreement on Social Security between the Republic of Serbia and the Republic of Slovenia were also adopted by a majority of votes.

On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the deputies complained of during the sitting and decided that the Rules of Procedure had not been violated in any of the cases.

Since the National Assembly had completed the discussion on all the items on the agenda and ruled on them, the Speaker of the National Assembly, Prof. Dr Slavica Djukic-Dejanovic, concluded the Seventh Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2009

Having concluded the session, Assembly Speaker Djukic-Dejanovic wished happy holidays to all the citizens of Serbia, on the behalf of the deputies and her own behalf. The Assembly Speaker thanked the deputies for their cooperation wishing them professional and personal luck and expressed her belief that the activity of the National Assembly would be even more successful in the year to come.
