Fourth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013

The Speaker of the National Assembly of the Republic of Serbia, Dr Nebojsa Stefanovic convened the Fourth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013, for Thursday, 31 October 2013, starting at 1 pm.
The sitting started a 2.20 pm.


The National Assembly adopted the following agenda:

By a majority of votes, the National Assembly decided to complete a joint debate in principle on items 1, 2, 3 and 4 on the proposed agenda, joint debate in principle and single debate on items 5, 41, 42, 14, 15, 16 and 17 on the proposed agenda, joint debate in principle and joint single debate on items 6, 7, 18, 19, 20 and 21 on the proposed agenda, joint debate in principle and joint single debate on items 8, 9, 24 and 25 on the proposed agenda, joint debate in principle and joint single debate on items 10, 11, 12, 26, 27, 28, 29 and 30 on the proposed agenda, joint single debate on items 22 and 23 on the agenda and joint single debate on items 31, 33, 34, 35, 36, 37, 38, 39 and 40 on the proposed agenda.

National Assembly Speaker Dr Nebojsa Stefanovic greeted, on the behalf of the MPs and himself, a group of pedagogists of the Serbian Grammar School in Budapest.

Having established the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Snezana Stojanovic Plavsic, Bojan Djuric, Milos Aligrudic, Nebojsa Zelenovic and Prof. Dr Janko Veselinovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

On the second day of the proceedings, 4 November, the National Assembly continued the joint debate in principle on items 1, 2, 3 and 4.

The Chair, National Assembly Deputy Speaker Konstantin Arsenovic invited, in addition to the representative of the submitter, Minister of Justice and Public Administration Nikola Selakovic, state secretaries at the Ministry of Justice and Public Administration Dr Danilo Nikolic and Nedjo Jovanovic, Assistant Minister of Justice and Public Administration Ljiljana Blagojevic, Section Chief at the Ministry of Justice and Public Administration Jovan Cosic and Senior Officer at the Ministry of Justice and Public Administration Zlatko Petrovic, to attend the sitting.

At the beginning of the debate in principle, Minister of Justice and Public Administration Nikola Selakovic gave opening remarks on the Bill on Seats and Territorial Jurisdiction of Courts and Public Prosecutors Offices, Bill amending and modifying the Law on Organisation of Courts, Bill amending and modifying the Law on Judges, and the Bill amending and modifying the Law on Public Prosecution.

For the remainder of the day, the National Assembly conducted the joint debate in principle on items 1, 2, 3 and 4.
On the third day of the proceedings, 5 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Aleksandar Jugovic, Miroslav Markicevic, Slavica Saveljic, Petar Petkovic, Vesna Jovicki, Bojan Djuric, Srdjan Milivojevic, Dragan Sormaz and Nebojsa Zelenovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly continued and, for the remainder of the day, conducted the joint debate in principle on items 1, 2, 3 and 4 on the agenda for the sitting.

The Chair, National Assembly Deputy Speaker Vesna Kovac, greeted the students of the High School of Economics, Law and Administration who followed part of the National Assembly session from the gallery of the Grand Hall, on the behalf of the MPs and herself.

On the fourth day of the proceedings, 6 November, the National Assembly continued and concluded the joint debate in principle on items 1, 2, 3 and 4 on the agenda for the sitting.

On the fifth day of the proceedings, 7 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Mirko Cikiriz, Ranka Savic, Branislav Mitrovic, Sanda Raskovic Ivic, Miodrag Linta and Ivan Jovanovic requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly went on to conduct a joint debate in principle and single debate on items 5, 14, 15, 16 and 17 on the agenda. The Chair, National Assembly Deputy Speaker Konstantin Arsenovic, informed the MPs that the Government had withdrawn from procedure, in writing, the Bill amending and modifying the Law on State Administration and the Bill amending and modifying the Law on Civil Servants.

The Bill amending and modifying the Criminal Code, submitted by a group of 65 MPs of the Serbian Progressive Party Parliamentary Group, was presented, on the behalf of the submitters, by Zoran Babic, Head of the Parliamentary Group.

By the end of the day, the National Assembly had concluded the joint debate in principle and single debate on items 5, 14, 15, 16 and 17 on the agenda.

On the sixth day of the proceedings, 8 November, the National Assembly conducted a joint debate in principle and joint single debate on items 6, 7, 18, 19, 20 and 21 on the agenda.

At the beginning of the debate in principle, the representative of the submitter, Serbian Prime Minister and Minister of Interior Ivica Dacic gave the opening remarks on the bills.

By the end of the day, the National Assembly had conducted and concluded the joint debate in principle and single debate on items 6, 7, 18, 19, 20 and 21 on the agenda.

On the seventh day of the proceedings, 12 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Sinisa Lazic, Bojana Bozanic, Zika Gojkovic, Judita Popovic, Srdjan Dragojevic and Momir Stojanovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

In the morning part of the proceedings the National Assembly commenced a joint debate in principle and single debate on items 8, 9, 24 and 25 on the agenda, viz. the Bill on Commodity Reserves, Bill amending the Law on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, Bill on the Confirmation of the Strategic Economic Cooperation Agreement between the Government of the Republic of Serbia and the Canadian Commercial Corporation, and the Bill on the Confirmation of Annex 2 of the Economic and Technical Cooperation Agreement in the Field of Infrastructure between the Government of the Republic of Serbia and the Government of the People’s Republic of China.

The Bill on Commodity Reserves was presented, on the behalf of the submitter, by Deputy Prime Minister and Minister of Foreign and Internal Trade and Telecommunications Rasim Ljajic and Minister of Energy, Development and Environmental Protection Prof. Dr Zorana Mihajlovic.

The Bills listed as items 9 and 24 were presented by Minister of Energy, Development and Environmental Protection Prof. Dr Zorana Mihajlovic, while Minister of Foreign and Internal Trade and Telecommunications Rasim Ljajic provided the rationale on the Bill listed as item 25.

On the eighth day of the proceedings, 13 November, the National Assembly commenced a joint debate in principle and single debate on items 10, 11, 12, 26, 27, 28, 29 and 30 on the agenda for the sitting.
Minister of Transport Aleksandar Antic provided the rationale for the bills.
By the end of the day, the National Assembly had conducted and concluded the joint debate in principle and single debate on items 10, 11, 12, 26, 27, 28, 29 and 30 on the agenda for the sitting.

On the ninth day of the proceedings, 14 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Enis Imamovic, Vesna Milekic, Radmila Gerov, Nebojsa Zelenovic, Suzana Grubjesic, Petar Petkovic, Mirko Cikiriz, Ivana Dinic, Gorica Mojovic and Dragan Sormaz, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly went on to conduct and conclude a joint debate in principle on the Bill on the Exercise of Right to Health Care of Children, Pregnant Women and Mothers, submitted by Member of Parliament Dr Nebojsa Stefanovic.

On the tenth day of the proceedings, 15 November, the National Assembly commenced and concluded a joint single debate on items 22 and 23 on the agenda for the sitting.
The Bill on the Confirmation of the Loan Agreement for the Privileged Buyer of E-763 Highway Construction Project (section Obrenovac - Ljig) between the Government of the Republic of Serbia represented by the Ministry of Finance and Economy as Borrower and the Chinese Export-Import Bank as Creditor, and the Bill on the Confirmation of the Agreement between the Republic of Serbia and the Kingdom of Morocco on Avoidance of Double Taxation with respect to Taxes on Income, were elaborated by Minister of Construction and Urban Planning Velimir Ilic.
The National Assembly proceeded to commence and conclude a joint single debate on items 31, 33, 34, 35, 36, 37, 38, 39 and 40 on the agenda.

On the eleventh day of the proceedings, 18 November, the National Assembly commenced and proceeded to conduct for the rest of the day, a debate in detail on item 1 on the agenda - Bill on Seats and Territorial Jurisdiction of Courts and Public Prosecutors Offices.

On the twelfth day of the proceedings, 19 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Arpad Fremond, Zoran Ostojic, Olgica Batic, Suzana Grubjesic, Milica Vojic Markovic, Srdjan Dragojevic, Srdjan Milivojevic and Katarina Rakic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly conducted and, by the end of the day, concluded the debate in detail on the Bill on Seats and Territorial Jurisdiction of Courts and Public Prosecutors Offices, Bill amending and modifying the Law on Organisation of Courts, Bill amending and modifying the Law on Judges and the Bill amending and modifying the Law on Public Prosecution.

The Chair, National Assembly Deputy Speaker Prof. Dr Zarko Korac reminded of the provision of article 87, paragraph 5, of the National Assembly Rules of Procedure according to which the National Assembly Speaker may set a Voting Day on a bill immediately after it has been discussed. In accordance with the provision, National Assembly Deputy Speaker Prof. Dr Zarko Korac set Wednesday, 20 November 2013, at 10 am, as Voting Day on the first four items on the agenda for the sitting viz. Bill on Seats and Territorial Jurisdiction of Courts and Public Prosecutors Offices, Bill amending and modifying the Law on Organisation of Courts, Bill amending and modifying the Law on Judges and the Bill amending and modifying the Law on Public Prosecution.

Voting Day

On Voting Day, 20 November, by a majority of MPs’ votes, the National Assembly adopted the Bill on Seats and Territorial Jurisdiction of Courts and Public Prosecutors Offices, Bill amending and modifying the Law on Organisation of Courts, Bill amending and modifying the Law on Judges and the Bill amending and modifying the Law on Public Prosecution.

After the National Assembly had completed the debate on the first four items on the agenda and ruled on them, the National Assembly continued the Fourth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013 with a debate in detail on the fifth item on the agenda.

The National Assembly conducted and, by the end of the day, concluded the debate in detail on the Bill amending and modifying the Criminal Code.

On the fourteenth day of the proceedings, 21 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Mirko Cikiriz, Zoran Ostojic, Slavica Savic, Radmila Gerov, Miroslav Markicevic, Dr Nikola Jovanovic, Dusica Morcev, Sasa Dujovic, Dr Janko Veselinovic and Dr Ljubisa Stojmirovic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly went on to conduct and conclude a debate in detail on the Bill on Detective Activity and the Bill on Private Security.

On the fifteenth day of the proceedings, 22 November, the National Assembly commenced and concluded a debate in detail on the Bill on Commodity Reserves and the Bill amending the Law on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction.

After recess, the National Assembly commenced and concluded a debate in detail on the Bill on Railway Safety and Interoperability, Bill amending and modifying the Law on Public Roads and the Bill amending and modifying the Law on Maritime Navigation.

On the sixteenth day of the proceedings, 26 November, before moving on to the agenda, the heads i.e. authorised representatives of the parliamentary groups, MPs Jelena Travar Miljevic, Kenan Hajdarevic, Janko Veselinovic, Mirko Cikiriz and Milan Lapcevic, requested information and explanations in line with article 287 of the National Assembly Rules of Procedure.

The National Assembly went on to conduct a debate in detail on the 13th item on the agenda - Bill on the Exercise of Right to Health Care of Children, Pregnant Women and Mothers.

As the National Assembly had concluded the debate on all the items on the agenda, the Chair, National Assembly Deputy Speaker Konstantin Arsenovic, set Tuesday, 26 November 2013, starting at 2 pm, as Voting Day on all the items on the agenda for the Fourth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013, except for items 1, 2, 3 and 4 on which the National Assembly had already voted, on 20 November 2013.

Voting Day

On Voting Day, 26 November, by a majority of MPs’ votes, the National Assembly adopted the Bill amending and modifying the Criminal Code, Bill on Detective Activity, Bill on Private Security, Bill on Commodity Reserves and the Bill amending the Law on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction.
By a majority of MPs’ votes, the National Assembly also adopted the Bill on Railway Safety and Interoperability, Bill amending and modifying the Law on Public Roads, Bill amending and modifying the Law on Maritime Navigation and the Bill on the Exercise of Right to Health Care of Children, Pregnant Women and Mothers.
On Voting day, by a majority of votes, the National Assembly also passed the Bill amending the Law on the Confirmation of the Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters, Bill amending the Law on the Confirmation of the Convention on the Taking of Evidence Abroad in Civil or Commercial Matters, Bill on the Confirmation of the Agreement between the Republic of Serbia and the Republic of Belarus on Legal Assistance in Civil and Criminal Matters and the Bill on the Confirmation of the Fourth Additional Protocol to the European Convention on Extradition.

By a majority of votes, the MPs also adopted the Proposal of the Decision on the Termination of Office of Public Prosecutor at the Appellate Public Prosecutor’s Office in Kragujevac, Proposal that the National Assembly adopt the Decision noting the existence of sufficient grounds for the termination of office of Deputy Ombudsman, Proposal of the Decision on the Election of Deputy Ombudsman, Proposal of the Decision on Dismissal of National Education Council Member and the Proposal of the Decision on the Election of National Education Council Member.
By a majority of MPs’ votes, the National Assembly elected Dr Vladimir Vukasinovic National Education Council Member from the ranks of the Serbian Orthodox Church. On Voting Day, by a majority of votes, the MPs also adopted the Proposal of the Decision on the Election of two members of the National Council for Higher Education.
By a majority of MPs’ votes, the National Assembly also adopted the Proposal of the Decision amending the Decision on the Establishment of the Composition of the Standing Delegations of the National Assembly of the Republic of Serbia to International Parliamentary Institutions, Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Social Democratic Party of Serbia Parliamentary Group and the Proposal of the Decision amending the Decision on the Election of Members and Deputy Members of the Committees of the National Assembly of the Republic of Serbia, submitted by the Democratic Party of Serbia – Vojislav Kostunica Parliamentary Group.
On Voting Day, the National Assembly also ruled on the violations of the Rules of Procedure the MPs complained of in the course of the Fourth Sitting of the Second Regular Session and decided that none of the provisions of the Rules of Procedure had been violated.
As the National Assembly had completed the debate on all the items on the agenda and ruled on them, National Assembly Speaker Dr Nebojsa Stefanovic concluded the Fourth Sitting of the Second Regular Session of the National Assembly of the Republic of Serbia in 2013.
