Fourth Meeting of the Working Group for the Improvement of the Electoral Process
The Working Group for the Improvement of the Electoral Process held its fourth meeting in the National Assembly on 30 September 2024, starting at 11 am.
The meeting was chaired by Nemanja Nenadic, Chairman of the Working Group, and attended by Working Group members Ugljesa Mrdic, Ana Krstic, Luka Pusic, Uros Kandic, Zagorka Aleksic, Djordje Komlenski, Pavle Dimitrijevic and Bojan Klacar, as well as substitute members Marko Milosevic, Kristina Antic, Aleksandar Stevanovic and Vladana Jarakovic.
The meeting was also attended by adviser to the National Assembly Speaker Mr Mihajlo Zivkovic and associates to the National Assembly Secretary General.
The Chairman of the Working Group proposed the following agenda for this meeting:
- Briefing the members of the Working Group on the Bill amending and modifying the Law on Prevention of Corruption, and the positions of the Working Group member whose proposals were the starting point for the drafting of the Bill;
- Briefing the members of the Working Group on the Bill amending and modifying the Law on the Single Electoral Roll and the positions of the Working Group member whose proposals were the starting point for the drafting of the Bill;
- Briefing the members of the Working Group on the proposals for measures submitted by the members of the Working Group in the period after the Third Meeting of the Working Group;
- Consideration of the work dynamics of the Working Group in the coming period according to priorities and informing the members of the Working Group about the planned legislative activities, in accordance with item 5 of the Decision on the formation of the Working Group for the Improvement of the Electoral Process;
- Agreement regarding deadlines for proposing measures for acting on recommendations from the Final Report of the ODIHR election observation mission for local elections in the Republic of Serbia, held on 2 June 2024;
- Miscellaneous.
The proposed agenda contained, as the first two items, the consideration of the proposed conclusions submitted by Working Group member Djordje Komlenski, that it is not necessary to take legislative or other measures regarding certain ODIHR recommendations. The Chairman pointed out that the decision of the Working Group on these proposals is a preliminary question for the consideration of any proposal related to those ODIHR recommendations, that is, in the specific case, to the amendments to the Law on Prevention of Corruption and the Law on the Single Electoral Roll. Working Group member Djordje Komlenski informed the attending that he had withdrawn his proposals just before the start of the meeting.
Under item one on the agenda, the Chairman informed the Working Group members about to the views of Transparency Serbia regarding the Bill amending and modifying the Law on Prevention of Corruption prepared by the National Assembly Support Service based on the proposal of Transparency from May 2024. In doing so, he specifically explained the differences between the solutions from this Bill and the solutions found in the original proposals of Transparency Serbia. As key items of difference, he highlighted the definition of promotional activities of public officials and the duration of the period in which these activities would be limited. In the discussion, the members of the Working Group focused on the arrangement of the accounts of public officials on social networks, including the danger of abuse of the so-called fake accounts on social networks, which are in the name of public officials, presenting various ideas on how to prevent these abuses. The Chairman noted that the Ministry of Justice plans to organise a public debate on the Bill amending and modifying the Law on Prevention of Corruption, which was prepared in order to fulfil the recommendations of GRECO and that, due to the simultaneous decision-making by the National Assembly on all changes in this law, it would be good to align the activities of the Working Group with the activities of the Ministry of Justice and in this sense suggested that the Working Group resume its work as soon as possible.
Under item two on the agenda, Working Group member Pavle Dimitrijevic informed the attendees of the CRTA Association's key comments regarding the solutions from the Bill amending and modifying the Law on the Single Electoral Roll submitted by the National Assembly Support Service before this meeting. He emphasised that the Bill refers to two key elements, namely: publicly available data from the single electoral roll and the formation of a commission that would be tasked with conducting an independent audit of the roll. Regarding the availability of data from the single electoral roll, some members of the Working Group expressed scepticism regarding the proposed solutions, stating that the publication of the number of voters per household, i.e. the number of apartments, would certainly lead to serious abuses and could endanger the lives and property of many citizens. In the further discussion, it was considered how to reach a balanced solution where, on the one hand, the interest of the public would be satisfied that certain data from the single electoral roll be available to it, but so that, on the other hand, there is no danger of jeopardizing the safety of citizens. The most significant differences during the discussion occurred in connection with the duration of the mandate, as well as the composition (proposers) of the commission that would deal with the revision of the single electoral roll.
By the end of the work, the members of the Working Group had familiarised themselves with the currently available information on the planned legislative activities of other state bodies. The Chairman emphasised that it is necessary for the Working Group to determine the dynamics of its future work, which would be based on previously obtained information on the legislative plans of the relevant ministries. In this regard, he mentioned that the Ministry of Justice published drafts of amendments to the Criminal Code and the Criminal Procedure Code and suggested that the Working Group contact this Ministry in order to try to reach the most optimal solutions through a joint effort, because the said drafts do not contain anything of what was proposed by certain non-governmental organisations and members of the Working Group in the previous period, regarding this matter. It was concluded that the National Assembly Support Service should be asked to obtain information from the relevant ministries on the planned changes to the law, which should also address certain ODIHR recommendations, before the next meeting of the Working Group at which the topic will be determining the dynamics of the Working Group's work. At the same time, the Chairman proposed that the members of the Working Group submit proposals for legislative or other measures that would refer to the ODIHR recommendations from June 2024, by 8 October 2024, as well as to correct or supplement previously submitted proposals related to said recommendations.
